Working title is <br />BHDTA. <br />We next discussed height limit restrictions as described in our zoning ordinance. Mr. <br />Wippich promoted moving away from current language, of strict height requirements and <br />moving instead towards median height measured from a predetermined elevation. If <br />enacted, this would allow for more varied roof heights, which would be consistent with. <br />our preference for unique house designs. This also would allow for easier compliance <br />with state energy code requirements. <br />At 7:45 Jack Hoeschler arrived fresh from Italy. Mr. Lindner refused to yield the chair to <br />Mr. Hoeschler. <br />Church zoning was the next topic. Mr. Hoeschler introduced the group to RLUIPA, the <br />Religious Land Use and Institutionalized Persons Act of 2000. This act limits a city's <br />ability to prevent churches from entering a community through restrictive zoning <br />requirements. Jack briefly discussed Lake Elino and Eden. Prairie as two cities with <br />successful limits to church growth through zoning controls that comply with RLUIPA.. <br />Sonie metro area churches exist through PUD ordinances. <br />Finally we discussed site control, particularly as it relates to Hillary Farm, but in general <br />for all future developments, specifically those involving density transfer or restrictive <br />covenants. The group agrees site review should roll up to the. Zoning Administrator, but <br />there should be some guidelines drafted by the Planning Commission. The Planning <br />Commission should also become involved in more complex zoning situations. <br />Due to several scheduling conflicts our next meeting will be moved to Wednesday, July <br />14, 2004..Notification must go to the city clerk for publication. <br />There being no further business, the meeting adjourned at 8:3.5PM. <br />
