No person shall collect mixed municipal solid waste (MSW) from residents within the city without first. <br />securinga license from the city. The city council, in the interest of maintaining healthful and sanitary <br />conditions in the. city, as well as to protect the public infrastructure, hereby reserves the right to limit the <br />number of licenses to seven. <br />(Prior Code, § 1.05-080) <br />Sec.. 62-57. - License requirements. <br />In order to avoid disruption of collection services to businesses and residents of this'city,.licenses.wiII <br />first be made,avaiIable to those haulers in good standing which are operating in the city at the time of <br />enactment.of the ordinance from which this chapter is derived. All persons engaged in the business of solid <br />waste collection in the city must.have a I'icense, Each licensee and hauler shall be subject to the following <br />restrictions: <br />(1) The. license shall be valid for one year, and shall expire on December 31 each year,:unIess <br />revoked.sooner. <br />(2) The License is nontransferable, .unless approved .by the city council, The Licensee shall not be <br />entltled to a. refund of any license fee upon revocation or voluntarily ceasing to carry on the <br />license activity. <br />(3) An applicant fora license shall make application to the city clerk through forms and <br />procedures prescribed by the city clerk. The.application for a Iicense.shall contain, as a <br />minimum, the following information: <br />a. The name, phone number, and current.address of the applicant. <br />b.. A list of the eplaces to which the solid. waste and/or recyclables are to be hauled. <br />C. Information. about the location and method of storage of collected recyclabie materials, <br />including evidence of compliance with all city, county, state, and federal laws and <br />regulations. <br />(4) The.annual license fee shall be as established by the city council, <br />(5) Applications for license renewal must be received by the city clerk by November.1 of each <br />year for renewal of the license for the following.year. Renewal applications received. on or <br />after.November 1 will be administered as an application for a new license. <br />(6) The city.elerk shall issue license renewals after: <br />a. The applicant has completed and submitted all required farms and applications. <br />b. The applicant has provided proof of insurance, as require d.0rid er section 62=58: <br />c.
