to current training protocol and as required under federal and -state law, and. no. liability shall attach to the City of White Bear Lake by reason of any such request for service. or by reason of any negligent act or omission of any of the personnel. sent:by the City of White Bear Lake in connection with the service request; if multiple requests for service occur at the same time within.the City of White Bear Lake Police Department's service area, the. City of White Bear Lake Police Chief or a.. designee shall have the unfettered discretion to direct the deployment. of available vehicle(s), equipment and personnel to a certain location or locations. The City of White Bear Lake and its officers and employees shall not be liable to any party to this Agreement or any other person for any failure to furnish assistance under this Agreement or for recalling assistance as provided Herein, should. conditions or circumstances warrant such action. Said services shall includeenforcement of State Statutes and Ordinances -of the City of Gem Lake dealing with.law enforcement ofthe'same type or nature as Ordinances ofthe City of White Bear Lake. The. White Bear Lake Police will enforce traffic. laws only when violations thereof occur intheir presence when performing patrol and call service as provided for herein. The White Bear Lake Police will have the sole discretion of enforcing traffic laws. by use of radar; etc. 2. The City of White Bear Lake shall furnish and supply all necessary labor, supervision, equipment; communication facilities; and supplies. necessary to maintain the level of service to be'rendered hereunder. Inthe event that this Agreement is terminated as herein provided, all such.equipment and material. shall remain the property ofthe City of White Bear Lake. Where special supplies, stationery, notices, forms and the like must be issued in the name ofthe City of Gem Lake, such shall be supplied by the City of Gem Lake at its .own cost and expense. In the event that this: agreement is terminated as herein provided, all such materials. and. supplies shall remain .the property Of the City of Gem Lake. 3. As additionally provided by Minnesota Statutes, Section 471.59, Subdivision 12; all personnel ofthe City of White Bear Lake Police Department shall be duly appointed police. officers authorized to act on all law enforcement matters within the limits ofthe City of Gem Lake in . the same manner and to the same'extent asthough they were employees ofthe City of Gem Lake. It is understood and agreed that all personnel of the. White Bear Lake Police Department performing. duties under this agreement are not employees. of the City of Gem Lake. The City of White Bear Lake Police Chief or a designee shall regularly inform the City of Gem Lake of any personnel. changes in the. City of White Bear Lake Police Department, 4.
