CITY OF GEM LAKE <br />RESOLUTION NO.2005-10. <br />20 JUNE 2005 <br />A RESOLUTION AMl9N6ING THE DEVELOPER'S AGREEMEW.Ay <br />AND BETWEEN THE CITY OF GEM LAKE AND MC NULTY <br />COMPANY; it/bla/ HILLARY FARM, LLC AND. PROVIDING FOR <br />REVISIONS IN: THE. SCHEDULED INSTALLATION OFTHE WALKING <br />TRAIL ON THE DEVELOPMENT. <br />WHEREAS, a Developer's. Agreement by and between the..City of Gcm Lakti.and McNulty Company;..dlb/a/ Hillaity <br />Farm, LLC was executed in 2004 and said.Developer's.Agreemeirt..ostablished. certain time tables for completion.of the <br />worl4 to be perrilnued :including installation of the walking trail; and <br />WHEREAS, the Developer has*m questerl*an amendinerittosaid schedule. for installation of the walking trail in an effort <br />to avoid-unnocesmry costs including ripping.gp*the trail to install sewer: laterals to: the lots; now, therefore, be it <br />RESOLVED; that the City Council:of:thie City'of Gem Lake does herebyapprove amending ilte schedule .defined in <br />Section L h. of the. Developer'§ Agreement for installation of the walking path and providing for immediate installation <br />of 3 sections including; 1) approximately eight -hundred (800') feet more or less commencing..at the north entrance to <br />Hillary Farin to the first cul-de-sac; and, 2) approximately seven -hundred twenty (720') feet more or less commencing <br />at the south entrance .to Hillary Farm to the Lot 42 dri.veway;. and.).approximately three -hundred fifty (550') fi et from <br />Lot fr;8 to Lot # I2. <br />FURTHER RESOLVED that the balance of the walking path shall be installed prior to.3.t October 200E unless the <br />developer has requested further extensions for cause. <br />The foregoing Resolution was offered. by CoupGilpr.
