CITY OF GEM LAKE MINUTES OF PUBLIC HEARING NO. C2006-02 10 April 2006 Gem Lake Public Hearing No. C2006-02 was convened at 7:08 PM on Wednesday, 12 April 2006 in the first floor meeting room ofTousley Ford. Mayor Emeott, Councilors Watson, Bosak, and Rasmussen, Clerk Magnuson and Project Engineer Mitchell were present. Clerk Magnuson reported that the public hearing was properly noticed with Public Notice No. 2006-10a published in the White Bear Press on 29 March 2006 and Public Notice No. 2006-10d mailed on 28 March 2006 to all fee title owners of real property on Tessier Road and Haven Lane based upon records of Ramsey County Property Records and Revenue. Mayor Emeott made opening remarks, stating that the process of securing a feasability study for the reconstruction of city streets began 2003, was ordered in April, 2005, upgraded in July 2005 to include city water and sewer, and reviewed in March, 2006. The final feasability study for the work is to be presented here this evening. Emeott noted the inclusion of city water and sewer in he feasability study was consistent with best management practices and the time line established in the Gem Lake Comprehensive Municipal Plan of 1997. Emeott indicated that the City is also having a feasability study completed for development of a City Water Plan which at some time in the near future could put city water in proximity to the Big Fox/Little Fox neighborhood. The primary purpose of this hearing is to receive the Project Engineer's Feasability Study and receive public comment from those affected by the proposed improvements. Engineer Mitchell then presented the Feasability Study and the Summary, copies of which are attached hereto. As the Feasability Study was already accepted at Public Hearing No. 2006-01, acceptance was waived. Clerk Magnuson then identified several scenarios for needing to suddenly install city water including, but not limited to, chemicals spills from adjacent industry or transportation, groundwater contamination, influence or mandate by other govermnent agencies (MPCA, DNR, Public Health, Met Council, etc). Emeott cited North Oaks problems from former dump. Magnuson cited recent fire at paint factory just north of the neighborhood and spills at wood treatment plant. Magnuson asked if anyone present has had their well tested recently to which no response was received. Discussion followed regarding mandatory well testing and the Clerk made note to consider the project asking the neighbors to draft a petition requesting same. Clerk Magnuson then read into the record written comments received from Dan and Sally Hendrickson of 3930 Tessier Road, a copy of which is attached hereto. Mayor Emeott then opened the floor for public comment as follows: DEB LARSEN If no one is pressing to install sewer, and water, why install the pipes? Emeott -best management practices encourage looking at the possibility and we would be remiss in our duties as a Council not to do so, especially when we are unaware of your feelings toward sewer and water. Inappropriate to dig up recently paved road to install sewer and/or water if mandated. What are costs and what is included. Mitchell responded per summary sheet. Magnuson also indicated perhaps some of the maintenance money budgeted this year could be used for a portion of the curb reconstruction. The snow plowing contractor may also have a stake in the matter due to snow plow damage. JERRY LARSEN Is there a time line under which sewer and/or water might be mandated by others? Magnuson - None that we are aware of now but that is subject to the decisions of others. Unplanned installations are substantially more expensive. -1-
