<br />across these lots. In addition to those three lots, you would <br />utilize the area that Williams Brothers pipeline owns. Those <br />pipelines would be lowered and a new pond constructed generally <br />in a rectagular configuration. I would like to point out, by <br />doing this it necessitated taking this 96 inch oval pipe that <br />exists, taking it out and using those pieces of pipe to <br />reconstruct a new pipe line on a diagonal. It would run from the <br />SE corner to the NW corner. In doing that, predominantly the <br />pond would then be south of that pipe on the city lots and the <br />Williams Brothers property. In extreme rainfall conditions, for <br />a very short time the water would then also be located in the <br />extreme northeasterly corner of the City property. In doing this <br />the shopping center land would now be free for development. It <br />would necessitate the shopping center to construct a retainer <br />wall along the south boundary of the bond in order to retain the <br />full usage of the property that they have. Otherwise it would be <br />taken up in sloping. It is expected that the pond would have a <br />fence around it. It also is expected that the pond would be <br />landscaped to screen and beautify the area. Also there would be <br />pickup facilities located just outside the pond on the edge of <br />the private property to the southwest and to the southeast. It <br />would also necessitate getting an easement across a corner of the <br />lot at 1728 Oakcrest. Due to the fact that it will not be <br />necessary to pay for the extra easement, it would compensate for <br />the cost of relocation of the pipe. We find this improvement to <br />be feasible and would recommend it to the Council. The only real <br />condition, I guesss, is that we are in communication with the <br />William Brothers, and we believe we will be able to get that <br />easement. In the event, that it becomes impossible or imprac- <br />tical from a cost standpoint, it may be necessary to take a small <br />amount to to replace some of the easement land that we've used <br />there. At this point, it does not look like it would be <br />necessary, based on our conversations with Williams Brothers. <br />The people from the shopping center to the southwest also have <br />agreed not only to build a retaining wall but to maintain the <br />pond and all of the other boundary areas for uniformity of main- <br />tenance and appearance. I would be happy to answer any <br />questions. <br /> <br />DEMOS: Does the council has any questions or comments? <br /> <br />JOHNSON: Has this been agreed on, by all the members? <br /> <br />HONCHELL: This has been agreed to by everyone. Agreed to is <br />probably not the right word. This has been discussed with those <br />who have an immediate impact, such as the neighbors which the <br />pond will corne the closest to. It has been agreed to by the <br />shopping center to the southwest. The Shopping center to the <br />southeast, to my knowledge based on discussions, has no objections <br />to it. They were happy with the last plan as well. They say we <br />do have to negotiate an easement over that parcel. I don't know <br />about the individuals in the room tonight, they can speak for <br />themselves, but to my knowledge there is no special problem with <br />doing it, because we would also be doing some work in the <br />backyards to correct some existing drainage problems already <br />there. <br />
