Regular City Council Meeting <br /> Monday,August 22,2011 <br /> Page 32 <br /> Chief O'Neill advised that there was a"hard stop"to the contract after Phase I, al- <br /> lowing the City to rebid if for any reason at that point they were unhappy with <br /> services of Bossardt to-date. <br /> City Attorney Bartholdi concurred with Chief O'Neill, that the City could termi- <br /> nate the contract at that point for any reason. <br /> Councilmember Pust asked that City Attorney Bartholdi verify the specifics of the <br /> contract to ensure that option. <br /> Councilmember McGehee asked that City Manager Malinen, in future agenda <br /> packets, include additional information on the firms, as indicated by the additional <br /> information request prior to tonight's meeting by Mayor Roe; and the differences <br /> in the two (2) firms that scored highest. Councilmember McGehee questioned the <br /> criteria considered, in the interview section, of those items as not clearly measur- <br /> able; and opined that there was a need to have additional people on the interview <br /> team that could provide more expertise from a mechanical or building inspection <br /> standpoint, and having some familiarity with such a large-scale project such as <br /> this. <br /> Chief O'Neill advised that the evaluation team was originally opened up for par- <br /> ticipation to any City employee having an interest or time to participate; and with <br /> the exception of Police Chief Mathwig, no one had come forward to serve as part <br /> of the team. Chief O'Neill clarified that the purpose of seeking a construction <br /> manager was based on the lack of expertise, with the exception of the expertise of <br /> Fire Marshal John Loftus and Hugh Thibodaux, a retired electrical engineer for <br /> the U of MN, both of whom had been of invaluable assistance to-date on the eval- <br /> uation team. <br /> Councilmember McGehee, in her review of the top two (2) firms: Bossardt and <br /> Krauss Anderson, opined that each firm's credentials, rating with the Better Busi- <br /> ness Bureau (BBB), their community involvement, and other criteria should have <br /> weighted in the best value process as well. Councilmember McGehee compared <br /> the 100 year history of Kraus Anderson with the 27 year history of Bossardt. She <br /> stated that Bossardt was not listed with the Better Business Bureau and that Kraus <br /> Anderson had been a member since 1973 and had an A+ rating. She also noted <br /> that while they were both local companies, Kraus Anderson donates 2% of pretax <br /> profits to Keystone (a community support group) and actively supports Hearts and <br /> Hammers and Walk for Hope. She also noted the difference in the Phase I fees <br /> with Krause Anderson the lower bid by $14,000.00. Given her personal research, <br /> Councilmember McGehee questioned if Bossardt was the firm that should be <br /> awarded the contract, rather than Krauss Anderson. <br /> Chief O'Neill opined that the criteria suggested by Councilmember McGehee was <br /> not part of the evaluation criteria used; and as far as using anyone other than the <br />
