303 <br />304 Items for Discussion, Information, and Possible Action <br />305 GLWMO Joint Powers Agreement (JPA) / By -Laws <br />306 Chair Eckman advised that the current JPA (as revised in 2005) included provisions for capital <br />307 improvements and budget approval that are not acceptable to BWSR. Chair Eckman advised that <br />308 information had been provided via e -mail to member Cities, in care of Mr. Schwartz at Roseville and Mr. <br />309 Maloney at Shoreview, alerting them to the necessary changes. Chair Eckman noted that she had been <br />310 advised by Melissa Lewis of BWSR that the Third Generation Plan would not be approved without an <br />311 approved JPA in place before the end of the Plan approval process, even though governance and finance <br />312 structure may change in the future, creating the need for a further revised JPA. Chair Eckman advised <br />313 that the JPA would need to be brought into compliance with BWSR rules, and while not complicated, it <br />314 required a review of state rules and statutes, with Ms. Lewis offering her assistance. Chair Eckman <br />315 suggested that the Board review the JPA and make suggestions for revisions, at which time the member <br />316 cities' respective City Attorneys be consulted for their expertise. <br />317 <br />318 Action Step <br />319 Chair Eckman sought a member of the GLWMO Board to draft a revised JPA to bring into compliance <br />320 with state rules (MN Rules 8410.0030 for JPA's) and applicable statutes, then to send to the respective <br />321 member cities for their review. Chair Eckman noted that to secure BWSR approval of the 3rd Generation <br />322 Plan a revised JPA may affect the GLWMO Board budget and capital improvement plans; as well as <br />323 impacting the future governance structure of the GLWMO. <br />324 <br />325 Member Miller volunteered to do so; and Mr. Petersen volunteered to work with Member Miller on the <br />326 draft JPA, noting that the Assessment List was currently incomplete. At the request of Member Miller as <br />327 to a timeframe for preparing the draft JPA, Mr. Petersen advised that it should be developed parallel to the <br />328 Third Generation Plan if at all possible, to allow review of the respective member city attorneys and part <br />329 of the upcoming 45 -day review process period. <br />330 <br />331 Mr. Miller advised that he would attempt to have a first draft of a revised JPA available to the GLWMO <br />332 Board for their August meeting. <br />333 <br />334 Lake Association Liaison Updates: Owasso, Wabasso, Snail <br />335 Member Miller had nothing new to report regarding Lake Owasso. <br />336 <br />337 Member Von De Linde advised that she had sent information to the Lake Association President on timing <br />338 issues before their next lake vegetation treatment; and had been advised that Lake Management, Inc. <br />339 would not be applying any application until a later period of time, allowing a window of opportunity for a <br />340 vegetation survey. <br />341 <br />342 Mr. Petersen advised that he had recently made arrangements for a meeting in the near future with a Snail <br />343 Lake youth resident and the Girl Scout troop leader, Ms. Beth Jackson, interested in advancing toward a <br />344 Girls Scout Gold Award by doing a macrophyte survey on Snail Lake. Mr. Petersen opined that this <br />345 would be a perfect public awareness campaign, planned snorkeling by this youth to complete the survey; <br />346 and the assistance of Mr. Petersen and Member Westerberg to this young lady in completing the project. <br />347 Mr. Petersen further opined that this would provide a great bridging opportunity with the Snail Lake <br />348 Homeowners Association. <br />349 <br />350 <br />351 <br />352 <br />353 <br />7 <br />
