repaired or reconstructed as to constitute a complete structure capable of being operated as <br /> required by the terms and conditions of this Agreement. <br /> If at any time during the Term of this Agreement,title to less than the whole or materially <br /> all of the Property and/or Improvements shall be taken, as aforesaid,this Agreement shall <br /> continue and Tenant shall promptly, except for unavoidable delays, at Tenant's expense, restore <br /> the Improvements to the extent as nearly as possible to the condition and character immediately <br /> prior to such partial taking. All of the compensation collected by Tenant pursuant to this section <br /> shall be applied and paid over toward the cost of demolition,repair and restoration of such <br /> partial taking, substantially in the same manner and subject to the same conditions as those <br /> provided in the section of this Agreement with respect to insurance and other monies. Any <br /> balance of the award or other compensation for such partial taking of the Improvements <br /> remaining after payment of such costs of Restoration, as aforesaid, shall be paid over to Tenant. <br /> 19. DEFAULT. If Tenant shall default in its performance of or compliance with any <br /> of the terms, covenants and agreements under- this Lease and such default shall continue for a <br /> period of thirty (30) days after written notice of such default from Lessor, or if Tenant shall be <br /> adjudicated bankrupt or insolvent or make an assignment for the benefit of creditors, then, in the <br /> event of any such situation, Lessor may, at its option, lawfully enter into and upon the Property or <br /> any part thereof and repossess the same and evict Tenant and all persons claiming under and <br /> through Tenant, and remove any effects, if necessary, without being guilty of trespass and without <br /> prejudice to any remedies which may be available for arrears of rent or for Tenant's breach of <br /> covenant, and upon entry as aforesaid, -this Lease shall terminate and wholly expire. The <br /> foregoing not withstanding, removal of any animals from the Facility must be performed with <br /> the utmostcare. <br />
