101 1 997 (Planning Commission- hearing on concept development plan), January 14, 1 998 <br /> (Planning Commission - continued hearing concept development plan and preliminary <br /> plat), January 26, 1998 (City Council - meeting on concept development plan and <br /> preliminary plat), and February 9, 1998 (city council - hearing on final development plan <br /> and final plat), to consider various aspects of the Planned Unit Development, including the <br /> plat of the subject property and rezoning of the subject property from SC Shopping Center <br /> and E-1 Limited Business to PUD Planned Unit Development. The CITY agrees to rezone <br /> the subject property to PUD, subject to the DE ELOPER's strict compliance with the <br /> approved plans, and the terms and conditions of this agreement. Minor variations from the <br /> approved final development plans may be approved by the CITY's Development Review <br /> cornmi tee, under the direction of the Community Development Director. Substantial <br /> departures from the approved final development plans will require an amendment to the <br /> Planned Unit Development in accordance with Section 1015 of the Roseville Zoning <br /> Ordinance. Where not superseded by more restrictive requirements of this PUD, the <br /> standards of the underlying SC (Shopping Center) zoning district shall apply, as stated in <br /> Chapter 1006 of the Roseville City Code. <br /> 6.0 Development of Property <br /> Failure b y the DEVELOPER to commence development activity, 'in accordance with the <br /> final development plans, within one year following the final approval of this Planned Unit <br /> Development, will necessitate the approval of an extension of the development schedule <br /> b y the City Council prior to the expiration of the one year period. If an extension is not <br /> applied for, the council may instruct the Planning Commission to initiate rezoning to the <br /> original SC and E'I zoning districts. For purposes of this provision, development activity <br /> shall be defined as obtaining a building permit and beginning construction on the site. <br /> Devel p men# of the property and installation of improvements shall be in accordance with <br /> the development schedule provided by the DEVELOPER and approved by the CITY <br /> (Exhibit I). <br /> 7.0 compliance with Laws and Regulations <br /> The DEVELOPER represents to the CITY that the proposed Development will comply with <br /> all City, Coun , Regional, Metropolitan, State, and Federal lags and regulations, including <br /> but not limited to the Roseville Subdivision Regulations, the Roseville Zoning Regulations, <br /> and all other applicable environmental regulations.
