A. <br />Department Approval: City Maria er Approval: agenda Section: <br />TP /DPW LAND USE <br />Item Description: A request by United Properties for a COMPREHENSIVE LAND USE PLAN <br />AMENDMENT, REZONING, PRELIMINARY PLAT, and GENERAL <br />CONCEPT PLANNED UNIT DEVELOPMENT, to allow the development <br />of a portion of the Midland Country Club (PF3471). <br />1.0 BACKGROUND: <br />1.1 United Properties (developer) in cooperation with Midland Hills Country Club seeks approval of a <br />Comprehensive Land Use Plan Amendment changing the designation from Low Density Residential to <br />Medium Density Residential and from Golf Course to High Density Residential; a Rezoning of property <br />from R -1, Single Family Residence District to Planned Unit Development with an underlying zoning of <br />R -3, General Residence District and R -6, Townhome District; a Preliminary Plat that takes 9 platted lots <br />and creates 6 town home lots with common area and 1 condominium lot with common area; and a <br />General Concept Planned Unit Development for a 30 unit condominium and 6 town home units (2 <br />structures — 3 units attached) on 4.2 acres located along Roselawn Avenue and Fulham Street. <br />PROJECT REVIEW HISTORY <br />• Sketch Plan Review of project on May 7, 2003 <br />• Applications submitted & Determined Complete — September 4, 2003 <br />• 60 -day review deadline on November 3, 2003 <br />• Staff Review: Approval with conditions — October 1, 2003. <br />• Planning Commission: Hearing & Approval (5 -1) Recommendation — October 1, 2003. <br />• City Council Action: October 20, 2003 <br />2.0 SUMMARY of RECOMMENDATION: <br />2.1 The Community Development Department recommends approval with conditions. <br />3.0 SUGGESTED ACTION: <br />3.1 Approve the request by United Properties for: <br />a. Comprehensive Land Use Plan Amendment from LR, Low Density Residential to <br />MR, Medium Density Residential & Golf Course to HR, High Density Residential. <br />b. Preliminary Plat creating 1 condominium lot and 6 town home lots. <br />C. Rezoning to Planned Unit Development with an underlying zoning of R -3, General <br />Residence District and R- 6, Townhouse District, with conditions (see Section 11 for <br />more detail).
