1.2 The Community Development staff sees no basis for reviewing the project under an <br />EAW because there are too few dwelling units in the Mogg propel to create <br />significant environmental effects, especially those effects to the wetland, that is <br />currently being impacted by the more than 100 homes, surrounding streets and <br />parking areas that directly discharge into the wetland. plus, the Mogg development <br />must meet storm specific water management requirements, which requires approval <br />by the Grass lake watershed. Further, the proposal is exempt and does not meet <br />the requirements for a discretionary review. ,ft <br />1.3 On Monday, August 25, the City Planner received an e-mail response from Travis <br />Germundson of the Department of Natural Resources stating that the proposed <br />Mogg development is adjacent unnamed wetland 62- 159w', which wetland does not <br />have a shoreland classification, is not within the jurisdiction of the DNR and would <br />not require a DNR permit (see attachment). <br />ow <br />1.4 In review of the current storm water collection system in the area, the City Planner has <br />concluded that 5 existing storm sewer lines from the adjacent area directly discharge into <br />the i `wetland # *. They include 2 from Cohansey Street, l from Sextant Avenue, I from <br />Transit Avenue, and 1 from County load C at Dale Street. <br />1.5 Staff has reviewed the comments from Council and the neighborhood regarding <br />environmental impact and damage to the wetland, concluding that; <br />Tree lass is permissible and unenforceable unless through a PUD. <br />The wetland is not a DNR jurisdiction wetland, and thus does not require f usher <br />review or perrm'tting from the ICI <br />The wetland is actually a large storm water management pond accepting area <br />storm water discharge for over 100 residential parcels. <br />The proposed Mogg development will be required to meet heightened storm water <br />management requirements that reduce phosphorus aftd , other particulates for <br />entering the wetland and controls the rate of runoff flow into the wetland (requires <br />subsequent watershed district approval) . <br />1.6 The Community Development Department, after reviewing Chapter 44 10, has determined <br />that that an EAw in not required for this development, and thus staff recornraends <br />approval of the proposal by Ramona Nogg & Moser Builders for a Plated Unit <br />Development General Concept Plan and Preliminary Plat for the development of 6 <br />owner occupied town home units with associated site improvements on property at 474 <br />County Road C. <br />PF3489 RCA PUD Concept 091 503 Page 2 <br />
