M <br />The City recognizes that the Plan will he a "covered entity" under H I PAX <br />Consequently, the vendor(s) rust submit, either as part of the contracts <br />described above or separately, a properly executed "business associate <br />agreement" (as required under H I PAA) and a letter representing and <br />warranting the vendors acknowledgment that H I I AA applies and its ability to <br />perform as a "business associate" (es that term is described in H I PAA). <br />Page 7 <br />
