The CITY shall not be liable for any <br />2 delay or default in completion of this work to the extent the delay or default is <br />3 caused by conditions beyond the CITY'S reasonable control. <br />4 <br />5 G. Arona Pond Pathway: with the exception of the pathway within the PLAT, <br />6 the CITY shall construct a pathway around Arona Pond, at its expense. The <br />7 pathway will connect to the proposed trail in the southeast corner of the <br />8 development. This project will be completed in conjunction with the Arona <br />9 Pond Improvements (paragraph 3F). This project cannot start construction <br />10 until easements have been acquired. <br />12 The CITE" shall not be liable for any delay or default in performance of the <br />13 construction of this improvement to the extent said delays or defaults is <br />14 caused by conditions beyond its control, including, without limitation, <br />15 suppliers, subcontractors, and third parties. <br />16 <br />17 14. Terrace Drive Extension: The CITY is working on plans and right- of- way <br />18 for the extension of Terrace Drive from the east boundary of the PLAT east <br />19 through the apartment property to connect to the existing Terrace Drive. This <br />20 project is presently proposed for construction Fall 2003 and cannot stag until <br />21 easements have becn acquired. <br />22 <br />23 The CITY shall not be liable for any delay or default in performance of the <br />24 construction of this improvement to the extent said delays or defaults is <br />25 caused by conditions beyond its control, including, without limitation, <br />26 suppliers, subcontractdrs, and third parties. <br />27 <br />28 4. Phased Development. The plat shall be constructed in two phases in accord with the <br />29 terms and conditions contained in this document as well as the PT TD Agreement. <br />30 <br />31 In Phase I the DEVELOPER has requested that the CITY approve a Manned Unit <br />32 Development (PLED) F## 3457) that redevelops one parcel as follows: 7 single family <br />33 homes, 1- 96 unit Cooperative Dousing Building, 18 townhomes, an approximately 2.2 <br />34 acre public park and an approximately 2.4 acre public park and pond area. <br />35 <br />36 In Phase 2 (Outlot A) of the Planned United Development, the DEVELOPER has <br />37 requested that the CITY approve 18 townhornes, alternatively, a 36 unit condomu' lium. <br />38 <br />39 The project address is currently 2800 Arona Street. The subject property, on which the <br />40 DEVELOPER housing will be built, will include a subdivision plat recorded with <br />41 Ramsey County.
