REQUEST FOR COUNCIL ACTION DATE: 7/13/87 <br />ITEM NO.: <br />Department Approval: Manager Reviewed: Agenda Section: <br />Hearings <br />Item Description: Fine Associates request for rezoning, special Use <br />Permit, and variance at 2665 and 2710 Snelling <br />Frontage Road. <br />The Roseville Planning Commission, at its July 1, 1987 meeting, <br />unanimously recommended approval of Fine Associates request for <br />rezoning from B-1 to B-1B at 2665 and 2710 Snelling Frontage Road. <br />The Roseville Planning Commission also unanimously recommended <br />approval of Fine Associates request for a Special Use Permit (P.U.D.) <br />at 2665 and 2710 Snelling Frontage Road, with the following conditions: <br />1. That the P.U.D. be developed in accordance with plans dated <br />5/29/87. <br />2. That the driveways be properly aligned. <br />The Roseville Planning Commission also recommended unanimous approval <br />of Fine Associates request for parking variance at 2665 and 2710 <br />Snelling Frontage Road. <br />The Roseville Planning Commission also unanimously recommended <br />continuing Fine Associates request for Special Use Permit (B-lB site <br />plan review) at 2665 and 2710 Snelling Frontage Road until the August <br />5, 1987 Planning Commission meeting. This would allow time to return <br />to the Planning Commission and Council with specific site plans for <br />Slumberland, the offices, and the Residence Inn. <br />In reviewing this approach with the City Attorney, Mr. Bell has stated <br />that by approving the zoning and P.U.D., etc., before the site plan <br />review is approved, the Council places itself in an extremely difficult <br />position to then deny a site plan review. In effect, if the proper <br />zone is in place, the developer can essentially request any type of <br />permitted B-1B development, and the site plan review cannot be denied <br />except for substantial health and safety reasons. Therefore, in order <br />to protect the City's options, it may be more appropriate to continue <br />all of the items until the August 10 City Council meeting. <br />COUNCIL ACTION REQUESTED: <br />Notion continuing Fine Associates request for rezoning, special Use <br />Permits, and variance at 2665 and 2710 Snelling Frontage Road to the <br />the August 10, 1987 City Council meeting. <br />
