Attachment G <br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />1 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City <br />2, of Roseville,, County of Ramsey, Minnesota, was held on the 25 th day of July 2011 at 6.-00 p.m. <br />3 The following Members were present.* <br />,4, and were absent. <br />5 Council Member introduced the following resolution and moved its <br />6 adoption.- <br />7' RESOLUTION NO. <br />8 A RESOLUTION APPROVING AN ASSISTED LIVING FACILITY AS A <br />9 CONDITIONAL USE AT 621-637 LARPENTEUR AVENUE (FF11 -013) <br />10 WHEREAS,, TOTI Development, LLC, applicant for approval of the proposed <br />11 conditional use,, owns the property at 621-637 Larpenteur Avenue, which is legally described as.- <br />12, PIN: 14-29-2 3-�44-0046 <br />13 Asylum Out Lots, subject to easements and roads, the S 185 feet of the part W of Water <br />14 Works Road right of way of Block I <br />15 WHEREAS,, the Roseville Planning Commission held the public hearing regarding the <br />16 proposed CONDITIONAL USE on June 1, 2011, voting 6-0 to recommend approval of the use based <br />1 7' on the comments and findings of the staff report prepared for said public hearing; - and <br />18 WHEREAS,, the Roseville City Council has determined that approval of the proposed <br />19 CONDITIONAL USE will not result in adverse impacts to the surrounding properties based on the <br />2,0 following findings.- <br />2,1 a. The proposed assisted living facility is not in conflict with the Comprehensive <br />2,2, Plan it advances theCOMDrehensive Plan's several aoals related to buffering <br />2,3 residential neiahborhoods from busv commercial areas or maior roadways like <br />24 Larpenteur Avenue; <br />2,5 b. The proposed use is not in conflict with a Regulating Map or other adopted plan <br />2,6 necause no SUCn Diann aDDIV to the area surrouncimL, the DrODertv-* <br />2`7 C. The proposed use is not in conflict with City Code requirements since permits <br />2,8 will not be issued if the Dlans fail to meet all of the relevant reouirements and_. <br />29 moreover,, the conditional use approval can be rescinded if the use or the property <br />30 fails at any time to comply with all applicable Code requirements or conditions of <br />31 the approval; <br />32, d. The proposed assisted living facility provides "high acuity"' care in which <br />33 residents are not allowed to drive or keep vehicles and all outdoor recreation <br />34 occurs within a secure,, fenced area,, which means that use of nearby parks would <br />Page I of 3 <br />
