4.1 In January of 2006, Bunten Inc. sought and received approval by the Roseville City Council for <br />multiple VARIANCES, VACATION of certain PUBLIC EASEMENTS and FINAL PLAT. Since that date <br />a number of circumstances has have occurred that have required modifications to either <br />easement documents or the mylars (plat document recorded at Ramsey County). One of the <br />modifications includes an additional lot for the City's land on which it lift station lies. <br />4.2 Since the initial City Council action, variances have been recorded against the property and the <br />office building has been constructed along with other site improvements. In December of 2007, <br />the easement agreement was finalized and signed by the City, but due to timing issues and the <br />absence of signatures, the FINAL PLAT could not be recorded. <br />REVIEW of REQUEST: <br />4.3 Three of the existing parcels addressed as 2361 Highway 36 West have a Comprehensive Land <br />Use Map designation of 1, Industrial and a zoning designation of 1 -1, Light Industrial. The <br />existing 5 lots addressed as 2325 Highway 36 West and 2357, 2335, and 2369 Fulham Street, <br />have a Comprehensive Land Use Map designation of B, Business and a zoning designation of <br />B-4, Retail Office Service District. <br />4.4 North of subject property is Ternes-Burton (manufacturing/light assembly) , zoned Light <br />Industrial; south is the Service Road and Interstate 35W; east is the Roseville West Building <br />(office), zoned Retail Office Service District; and west is Northstar Financial Forms (printing), <br />zoned Light Industrial. <br />5.0 STAFF COMMENTS - VACATION OF CERTAIN PUBLIC EASEMENTS: <br />5.1 The Planning and Engineering Divisions of the City of Roseville have reviewed the latest <br />documents pertaining to PUBLIC EASEMENT VACATION and concludes as it did in 2006 and 2007 <br />that the vacation of certain storm water pond easements will not adversely impact adjacent <br />and/or contiguous properties. <br />5.2 The Public Works/Engineering Division has reviewed the requirements of the Public <br />Improvement Contract and concludes that all required items have been met. This is represented <br />by the signed easement agreement of December 27, 2007. <br />6.0 STAFF COMMENTS - FINAL PLAT': <br />6.1 City Code Section 1011.04 (Necessary Data for Final Plat) identifies the required information <br />necessary for a FINAL PLAT approval. <br />6.2 The proposal by Bonten, Inc. seeks to consolidate 8 existing lots and/or parcels and create 4 <br />separate lots; 3 to include structures for which VARIANCES have been granted and I for land the <br />City owns on which a lift station/pump is located. <br />6.3 The Development Review Committee has reviewed the revised FINAL PLAT and supports the lot <br />configurations (to be consistent with the previous approval) and re-dedication of storm sewer <br />easements. <br />
