lls1Spvq+-J� <br />REQUEST FOR COUNCIL ACTION <br />Department Approval <br />M <br />Date.- 10/13/08 <br />Item No..- 12.d <br />City Manager Approval <br />Item Description.- Discuss Request by Kron Family for City Participation in Sanitary Sewer <br />Service Repair <br />I BACKGROUND <br />2 Bill and Anna Iron, who reside at 1221 West County Road B, have had ongoing problems with <br />3 their sanitary sewer service since they purchased the home over 5 years ago. The problems <br />4 worsened to a point where in February of 2007, they had to hire a contractor to dig and repair <br />5 their service line under the street. Shortly after the repair was completed, the Iron's sent a letter <br />6 to the City requesting some level of participation in the costs (See Attachment A)'. The Iron's <br />"7 also have corresponded with the Council on this matter and are seeking a determination <br />8 (Attachment B). <br />9 <br />10 We do receive several of these requests each year. The City Attorney has advised staff that the <br />"I'll City Code does not provide authority for participating in private lateral repairs other than those <br />12 which are determined caused by city actions or it contractors actions. In these circumstances <br />13 staff would document the specific cause or reason for city liability. <br />14 <br />15 After considerable discussion at your 6/30/08 council meeting the Council requested additional <br />16 legal opinion on the implication of city participation in private utility lateral repairs. The City <br />I 7 Attorney has offered the attached (See Attachment C), opinion in this matter. While the opinion <br />I states that current code does not allow participation, the code could be amended to allow such <br />19 participation at some level. A change authorizing could potentially have a significant financial <br />2 ('-) implication to future utility rates. With an estimated average cost of $,5000 each for over 9000 <br />2 1 single family homes in Roseville, the total cost implication is over $,45,000,000 if the city <br />22 assumed all liability for sanitary sewer laterals. This doubles if water laterals are included as <br />23 well. <br />24 <br />25 Staff has discussed potential options for resolution of this matter. They are.- <br />26 <br />27 1. Continue with current policy of service laterals being the responsibility of the <br />28 homeowner including all repair and replacement cost unless there is some culpability on <br />29 the part of the city. <br />30 2. Participate in service lateral pavement repair on County roads at some arbitrary level due <br />3 1 to higher pavement repair costs of high volume roads. <br />32 3. Assume full responsibility of service lateral costs in the right of way. This option has <br />33 very high potential future cost implications. <br />34 4�. Bid the pavement repair on county roads for lateral repairs for economy of scale and bill <br />Page I of 2 <br />
