Draft PUD Agreement <br />1 CITY of ROSEVILLE <br />2, PLANNED UNIT DEVELOPMENT AGREEMENT # <br />3 SEPTEMBER 15, 2008 (PF08-024) <br />Attachment H <br />4, AGREEMENT,, approved by the Roseville City Council on September 15, 2008, and entered <br />5 into between the City of Roseville- a Minnesota muniCiDal comoration (herein referred to as <br />6 '"CITY")_ and Presbvterian Homes Manaaement and Services- Inc- 2845 Ham line Avenue North- <br />7, Roseville,, Minnesota,, 55113 (herein referred to as "DEVELOPER" )�. <br />8 1.0 Effective Date of Agreement <br />9 This Agreement shall be effective upon completion of the following.- 1) passage of <br />10 Ordinance 4 (Rezoning of property to PIT); 2) publication of the ordinance in the <br />11 CITY's official newspaper; 3) execution of this agreement by the CITY and the <br />12, DEVELOPER; and 4) recording of this agreement with Ramsey County. <br />13 2.0 Request for Planned Unit Development Approval <br />14 The DEVELOPER has asked the CITY to approve a Planned Unit Development (PUD) <br />15 (PF08-024) that provides expands an office facility to a total of 50,965 square feet. The <br />16 property is described as.- <br />1 7' 2845 Hamline Avenue North (PIN.- 032923310026) City of Roseville, Ramsey County, <br />18 Minnesota; <br />19 and is legally described as.- <br />2,0 The east 33] feet of the north 2,74feet of the south 947feet of the northeast quarter of the <br />2,1 southwest quarter of Section 3, Township 2'9, Range 2'3, Ramsey ("ounly, Minnesota <br />3.0 Planned Unit Development Approval <br />The CITY hereby grants approval of the final development plan for the DEVELOPER, <br />subject to the compliance with the terms and conditions of this agreement and the <br />conditions of the City Council approval on September 15, 2008. The CITY agrees to <br />approve applications for building permits provided; the plans are consistent with the <br />exhibits approved at the concept and final stages of the Planned Unit Development <br />process; the DEVELOPER has not defaulted; and all of the standards and conditions of <br />this agreement have been satisfied. For three years from the date of this Agreement,, no <br />amendments to the CITY'S Comprehensive Guide Plan or official controls shall apply to <br />or affect the use,, development density, site layout, or dedication requirements of the land <br />included in the Planned Unit Development, unless required by state or federal law or <br />agreed to in writing by the CITY and the DEVELOPER. For any improvements proposed <br />thereafter,, notwithstanding anything in this Agreement to the contrary,, the CITY may <br />require compliance with any amendments to the City's Comprehensive Plan, official <br />controls, platting, or dedication requirements enacted after the date of this Contract. <br />Pagel of <br />
