Draft PUD Agreement 1 CITY of ROSEVILLE 2, PLANNED UNIT DEVELOPMENT AGREEMENT # 3 SEPTEMBER 15, 2008 (PF08-024) Attachment H 4, AGREEMENT,, approved by the Roseville City Council on September 15, 2008, and entered 5 into between the City of Roseville- a Minnesota muniCiDal comoration (herein referred to as 6 '"CITY")_ and Presbvterian Homes Manaaement and Services- Inc- 2845 Ham line Avenue North- 7, Roseville,, Minnesota,, 55113 (herein referred to as "DEVELOPER" )�. 8 1.0 Effective Date of Agreement 9 This Agreement shall be effective upon completion of the following.- 1) passage of 10 Ordinance 4 (Rezoning of property to PIT); 2) publication of the ordinance in the 11 CITY's official newspaper; 3) execution of this agreement by the CITY and the 12, DEVELOPER; and 4) recording of this agreement with Ramsey County. 13 2.0 Request for Planned Unit Development Approval 14 The DEVELOPER has asked the CITY to approve a Planned Unit Development (PUD) 15 (PF08-024) that provides expands an office facility to a total of 50,965 square feet. The 16 property is described as.- 1 7' 2845 Hamline Avenue North (PIN.- 032923310026) City of Roseville, Ramsey County, 18 Minnesota; 19 and is legally described as.- 2,0 The east 33] feet of the north 2,74feet of the south 947feet of the northeast quarter of the 2,1 southwest quarter of Section 3, Township 2'9, Range 2'3, Ramsey ("ounly, Minnesota 3.0 Planned Unit Development Approval The CITY hereby grants approval of the final development plan for the DEVELOPER, subject to the compliance with the terms and conditions of this agreement and the conditions of the City Council approval on September 15, 2008. The CITY agrees to approve applications for building permits provided; the plans are consistent with the exhibits approved at the concept and final stages of the Planned Unit Development process; the DEVELOPER has not defaulted; and all of the standards and conditions of this agreement have been satisfied. For three years from the date of this Agreement,, no amendments to the CITY'S Comprehensive Guide Plan or official controls shall apply to or affect the use,, development density, site layout, or dedication requirements of the land included in the Planned Unit Development, unless required by state or federal law or agreed to in writing by the CITY and the DEVELOPER. For any improvements proposed thereafter,, notwithstanding anything in this Agreement to the contrary,, the CITY may require compliance with any amendments to the City's Comprehensive Plan, official controls, platting, or dedication requirements enacted after the date of this Contract.
