85 5.0 ZONING: <br />87 5.1 The Roseville Planning Commission conducted a duly noticed public hearing on June 6, <br />88 2007 pertaining to the Cent Venture /Am West General Concept Planned Unit <br />89 Development Amendment voting 4 -2 to deny the submitted request. On December 17, <br />90 2007, the Roseville City Council approved the Preliminary Plan, Rezoning, and General <br />91 Concept Planned Unit Development Amendment. On May 19, 2005 the City Council <br />92 approved the Final Development Planned Unit Development, subject to the <br />93 DEVELOPER's strict compliance With the approved plans, and terms and conditions of <br />94 this AGREEMENT. <br />95 <br />96 5.2 The CITY confirms that the zoning of the subject parcels is as follows: <br />97 <br />98 Planned Unit Development with an underlying zoning of Mixed Use Business <br />99 District (B -5). <br />100 <br />101 5.3 The CITY further agrees to create this zone and overlay district subject to the <br />102 DEVELOPER's strict compliance with the terms and conditions stipulated in Section 9.1 <br />103 through 9.11 of this agreement, all approved plans, and other necessary approvals. <br />104 <br />105 5.4 Minor departures from the approved final development plans, which are consistent with <br />106 this AGREEMENT and the underlying Mixed Use Business District zone and/or the Cent <br />107 Ventures /AmWest Development PUD may be approved by the CITY's Development <br />108 Review Committee and the Community Development Director or designee, as provided <br />109 in the Roseville City Code (Section 1008). Substantial departures from the approved <br />110 final development plans will require an amendment to the Planned Unit Development in <br />111 accordance with Sections 1006, 10081 10101 1 0 12 and 10 15 of the Roseville City Code. <br />112 Where not superseded by more restrictive requirements of this PUD, the standards of the <br />113 underlying zone shall apply, as stated in Chapter 1 005 of the Roseville City Code. <br />114 Whether an issue is "minor" or "significant" shall be determined by the CITY as defined <br />115 in Section 1008.09 of the City Code. <br />115 <br />117 6.0 DEVELOPMENT of PROPERTY: <br />118 6.1 <br />The DEVELOPER shall commence and undertake site and structure development <br />119 <br />activities in accordance with the attached plans and maps as identified in Section 4 of this <br />120 <br />AGREEMENT and the terms and conditions identified in Section S and 9 of this <br />121 <br />AGREEMENT. <br />122 <br />123 6.2 <br />For purposes of this provision, development activity shall be defined as obtaining a <br />124 <br />building permit, commencing footings and foundations, and continuing with project <br />125 <br />construction on the site. <br />125 <br />127 6.3 <br />Development of the property and installation of public and /or private improvements shall <br />128 <br />be in substantial accordance with all approved plans (attached in this PUD Agreement) <br />129 <br />and /or as approved by the City. <br />3 <br />
