130 7.0 COMPLIANCE with LAWS and REGULATIONS: <br />131 7.1 The DEVELOPER represents to the CITY that any site improvements pursuant to the <br />132 proposed development Will comply With all City, County, Watershed, Metropolitan, <br />133 State, and Federal laws and regulations. <br />134 <br />135 8.0 SITE DEVELOPMENT REQUIREMENTS: <br />136 8.1 <br />To ensure that the proposed development meets the CITY'S requirements and standards <br />137 <br />for site development, the following provisions shall apply: <br />138 <br />139 <br />a. Final Grading Plan. The final grading plan for the hotel development must be <br />140 <br />reviewed and approved by the Director of Public Works before any permits will <br />141 <br />be issued. All grading shall comply with the approved grading plans and shall be <br />142 <br />the responsibility of the DEVELOPER. The DEVELOPER's engineer shall <br />143 <br />provide to the CITY a letter certifying that the grading project was constructed <br />144 <br />and was completed as depicted in the approved grading plan prior to the issuance <br />145 <br />of a Certificate of occupancy. <br />145 <br />147 <br />b. Final Utility Servicing Plan. The final utility servicing plan for hotel structure <br />148 <br />and/or site must be reviewed and approved by the Director of Public Works prior <br />149 <br />to any permits being issued for the building. <br />150 <br />151 <br />C. Erasion Control. Prior to site grading, and before any utility construction is <br />152 <br />commenced or building permits are issued, an erosion control plan must be <br />153 <br />submitted for approval by the Director of Public Works and /or the Rice Creek <br />154 <br />Watershed, and all erosion control actions shall be implemented, inspected and <br />155 <br />approved by the CITY. <br />155 <br />157 <br />d. Clean Up. The DEVELOPER shall clean dirt and debris from public streets that <br />158 <br />has resulted from construction work by said DEVELOPER or DEVELOPER'S <br />159 <br />CONTRACTORS, its agents or assigns. The CITY will determine whether it is <br />160 <br />necessary to take additional measures to clean dirt and debris from the streets. <br />151 <br />After 24 hours verbal notice to the DEVELOPER, the CITY may complete or <br />162 <br />contract to complete the clean up at the DEVELOPER'S expense. <br />153 <br />164 <br />e. Utility & Drainage Easements. The DEVELOPER is responsible for creating, <br />165 <br />dedicating and /or granting specific easements pertaining to public utility services, <br />166 <br />as approved by the City and /or storm water ponding and treatment as approved by <br />167 <br />Rice Creek watershed. <br />158 <br />159 <br />170 <br />171 <br />172 <br />173 <br />
