1. The Roseville Davanni's maintains an On Sale 3.2 Malt Liquor License <br />issued by the City of Roseville pursuant to Minnesota Statutes, Section <br />340A.404, Subdivision l and Section 302.02 of the Roseville City Code. <br />true and accurate copy of the Roseville Davanni's license is submitted <br />herewith as Exhibit A. A true and accurate copy of Chapter 302 of the <br />Roseville City Code is submitted herewith as Exhibit B. <br />2. on November 2, 2007, the l osevi.11e Davanni's liquor license was <br />suspended for one day as a result of an earlier 1 i quor code violation <br />involving serving alcohol to a minor. A true and accurate copy of the letter <br />from Roseville Police Chief Carol Sletner to the Roseville Davanni -'s <br />advising it of the November 2, 2007 license suspension, is submitted <br />herewith as Exhibit C.1 Davan-ni's did not request a hearing to challenge <br />that license suspension. <br />3. on November 2, 2007, the day when the suspension of the Roseville <br />Davanni's liquor license was in effect, a Roseville pollee officer went to the <br />Roseville Davanni's in plain clothes an.d ordered and was served a bottle of <br />beer. A true and accurate copy of the police- officer's incident report is <br />submitted herewith as Exhibit D. <br />4. Tinder Section 302.15(B) of the Roseville City Code, the presumptive <br />penalty for serving alcohol while the licensee's liquor liven -se is suspended <br />is revocation of the license. See Exhibit B. On January 10, 2008, <br />Roseville Police Sergeant Matthew Marshall sent a letter to the Roseville <br />Davanni's, notifying it of the November 2, 2007 liquor code violation and <br />the presumptive penalty. This letter informed Davanni's that at its regular <br />meeting on February H, , 008, the Roseville City Council would consider <br />whether to impose the presumptive penalty. Davanni's was invited to send <br />a representative to the February 11, 2008 City Council meeting to provide <br />any information relevant to that decision. A true and accurate copy of <br />Sergeant Marshall's January 10,- 2008 letter is submitted herewith as <br />Exhlblt E. <br />5. The City Council considered the presumptive penalty- issue at its February <br />1 I , 2008- meeting. Jennifer Weinhan.dl, the manager of the Roseville <br />Davanni's, appeared on behalf of Davanni's. Chief Sletner, Sergeant <br />Marshall and Ids. Wenhandl all provided lnfori- nation pertaining to the <br />November 2, 2007 liquor code violation.
