82 5.0 ZONING: <br />83 5.1 The Roseville Planning Commission conducted a duly noticed public hearing on October <br />84 11 2005 pertaining to the Metro Transit /Cent Venture /Old Dominion General Concept <br />85 Planned Unit Development voting 6 -0 to approve the submitted request. On October 13, <br />86 2005, the Roseville City Council approved the Rezoning and General Concept Plan. On <br />87 December 15, 2005 the City Council approved the Final Development Planned Unit <br />88 Development, subject to the DEVELOPER's strict compliance With the approved plans, <br />89 and terms and conditions of this AGREEMENT. <br />90 <br />91 5.2 The CITY confirms that the zoning of the subject parcels is as follows: <br />92 <br />93 40. Planned Unit Development with an underlying zoning of Mixed Use Business <br />94 District (B -5). <br />95 <br />96 5.3 The CITY further agrees to create this zone and overlay district subject to the <br />97 DEVELOPER's strict compliance with the terms and conditions stipulated in Section 9.1 <br />98 through 9.11 of this agreement, all approved plans, and other necessary approvals. <br />99 <br />100 5.4 Minor departures from the approved final development plans, which are consistent with <br />101 this AGREEMENT and the underlying Mixed Use Business District zone and/or the <br />102 Metro Transit /Cent Ventures PUD may be approved by the CITY's Development Review <br />103 Committee and the Community Development Director or designee, as provided in the <br />104 Roseville City Code (Section 1008). Substantial departures from the approved final <br />105 development plans will require an amendment to the Planned Unit Development in <br />106 accordance with Sections 1006, 10081 10101 1 0 12 and 10 15 of the Roseville City Code. <br />107 Where not superseded by more restrictive requirements of this PUD, the standards of the <br />108 underlying zone shall apply, as stated in Chapter 1 005 of the Roseville City Code. <br />109 Whether an issue is "minor" or "significant" shall be determined by the CITY as defined <br />110 in Section 1008.09 of the City Code. <br />111 <br />112 6.0 DEVELOPMENT of PROPERTY: <br />113 6.1 <br />The DEVELOPER shall commence and undertake site and structure development <br />114 <br />activities in accordance with the attached plans and maps as identified in Section 4 of this <br />115 <br />AGREEMENT and the terms and conditions identified in Section 5 and 9 of this <br />115 <br />AGREEMENT. <br />117 <br />118 6.2 <br />For purposes of this provision, development activity shall be defined as obtaining a <br />119 <br />building permit, commencing footings and foundations, and continuing with project <br />120 <br />construction on the site. <br />121 <br />122 6.3 <br />Development of the property and installation of public and /or private improvements shall <br />123 <br />be in substantial accordance with all approved plans (attached in this PUD Agreement) <br />124 <br />and /or as approved by the City. <br />125 <br />3 <br />
