125 7.0 COMPLIANCE with LAWS and REGULATIONS: <br />127 7.1 The DEVELOPER represents to the CITY that any site improvements pursuant to the <br />128 proposed development Will comply With all City, County, Watershed, Metropolitan, <br />129 State, and Federal laws and regulations. <br />130 <br />131 8.0 SITE DEVELOPMENT REQUIREMENTS: <br />132 8.1 <br />To ensure that the proposed development meets the CITY'S requirements and standards <br />133 <br />for site development, the following provisions shall apply: <br />134 <br />135 <br />a. Final Grading Plan. The final grading plan for the park and ride development <br />136 <br />must be reviewed and approved by the Director of Public Works before any <br />137 <br />permits will be issued. All grading shall comply with the approved grading plans <br />138 <br />and shall be the responsibility of the DEVELOPER. The DEVELOPER's <br />139 <br />engineer shall provide to the CITY a letter certifying that the grading project was <br />140 <br />constructed and was completed as depicted in the approved grading plan prior to <br />141 <br />the issuance of a Certificate of Occupancy. <br />142 <br />143 <br />b. Final Utility Servicing Plan. The final utility servicing plan for the park and ride <br />144 <br />structure and/or site must be reviewed and approved by the Director of Public <br />145 <br />Works prior to any permits being issued for the building. <br />145 <br />147 <br />C. Erosion Control. Prior to site grading, and before any utility construction is <br />148 <br />commenced or building permits are issued, an erosion control plan must be <br />149 <br />submitted for approval by the Director of Public Works and /or the Rice Creek <br />150 <br />Watershed, and all erosion control actions shall be implemented, inspected and <br />151 <br />approved by the CITY. <br />152 <br />153 <br />d. Clean Up. The DEVELOPER shall clean dirt and debris from public streets that <br />154 <br />has resulted from construction work by said DEVELOPER or DEVELOPER'S <br />155 <br />CONTRACTORS, its agents or assigns. The CITY will determine whether it is <br />156 <br />necessary to take additional measures to clean dirt and debris from the streets. <br />157 <br />After 24 hours verbal notice to the DEVELOPER, the CITY may complete or <br />158 <br />contract to complete the clean up at the DEVELOPER'S expense. <br />159 <br />160 <br />e. Utility & Drainage Easements. The DEVELOPER is responsible for creating, <br />151 <br />dedicating and /or granting specific easements pertaining to public utility services, <br />152 <br />as approved by the City and /or storm water ponding and treatment as approved by <br />163 <br />Rice Creek watershed. <br />154 <br />155 9.0 <br />SITE REQUIREMENTS <br />166 <br />SPECIFIC PUD STANDARDS and CONDITIONS of APPROVAL: <br />167 9.1 <br />Uses — Permitted: The permitted use of the subject property shall be those uses that are <br />168 <br />generally permitted and /or conditional by the underlying B -6 (Mixed Use Business) <br />169 <br />zoning district, subject to the following qualifications: <br />
