LefiNobl-Dwilk HIM 10-1� <br />APPLICANT: <br />RHIMI <br />City of Roseville <br />ACTION REQUESTED: Amendment to Zoning Ordinance Controlling <br />Newspaper Tubes <br />The City's legal counsel, Peterson, Bell, and Converse, upon inquiry from <br />Mr. North, Assistant City Manager, indicate that lin their opinion, the City <br />would have a right to eniact such legislation if they took care not to <br />I <br />"discriminate against or in favor of any particular newspaper or classifi- <br />cation of papers". A copy of that letter is attached to this repott. <br />2. On 11 March 1981, the City sent notices to the four newspapers serving <br />the Roseville area informing them of the 23 March hearing to be held by <br />the Council. ■ copy of that notice is attached. <br />Representatives of the newspapers appeared at the Council meeting and <br />voiced their concerns. A copy of the Roseville Sun Newspaper article <br />describing that meeting is attached for your information. It gives a <br />rather good overview of the meeting rosults. The City Council also <br />received a letter dated 23 March 1981 from the Minneaj)olis Star-Tribune <br />indicating their opposi tic n to the amendment and noting that <br />"We are qlad to cooperate and provide a flexibl-0. response with <br />respect to the placement and type of tul)es. We have made, <br />accommodations in tbe. past with other cmmuni.Hes who had <br />similar concern.c,-.
