e <br />6 June 1979 <br />PLMNING REPORT <br />CASE NUMBER: 1195-79 <br />,APPLICANT., James House <br />IOCATIO : Northwest Corner of County Road H -2 <br />and Rice Street <br />ACTION REQUESTED:, Special use Permit for Take -out Food <br />Services <br />Planned Unit Development <br />Approval of Preliminary Plat <br />Variance to sign Setback Requirements <br />PiANNING CONSIDERATIONS: <br />The property .in question is part of the old Kath property which has been <br />sold to Dr. -House. They propose at this time to plat the land into five <br />lots, with a private road connecting the parking areas through the center <br />between county Road B-2 and Transit Avenue. All of the land is zoned B-2 <br />with a portion of the land, 150 feet by 300 feet at the corner of county <br />Road H -2 and Rice* having been zoned B-3. The existing service station <br />and the structure to the north at this corner (on the H -3 land) will be <br />removed. The plat proposes an additional dedication of 17 feet along <br />Rice Street as requested by the City. We see no problems with the plat <br />except that there should be drainage easements on each lot line, private <br />roadway and an easement to elevation 952 on the pond. This is the <br />same elevation for ponding easement that was approved as a part of the <br />recently approved plAt for -duplexes on the north side of the pond., <br />2. The development proposed at this time relates to Lot 3 of the plat which <br />is a parcel 202 feet (frontage on Rice Street) by 288 feet (east -west <br />dimension on county Road B-2). This parcel is proposed to be developed <br />op <br />immediately for a pair of restaurants consisting of a ' "Mr* Donut's shop <br />and a "Gazeho'i restaurant. Each of these will have tape -out services <br />which requires a Special use Pe'nmit in the H -2 and H -3 Zones. <br />3. The development proposed is imaginative and unique inasmuch as the pair <br />of restaurants will share an outdoor patio area. This concept recognizes <br />the validity of restaurants being in groups rather than an isolated <br />location as has been well demonstrated by the development of the <br />restaurant complex west of Rosedale that was promoted by the city. <br />4 . The design • has been prepared by Dick Larsen, architect, for the applicant <br />who has submitted a well detailed site plan for the project. Attached <br />is a reduced copy of the site plan as proposed. <br />
