<br />City Council Study Session - 04/18/05 <br />Minutes - Page 13 <br /> <br />personal and may provide for the sale of any such property in <br />such manner as it shall consider for the best interests of the <br />Ci ty; <br />2) Authority to Acquire and Dispose of City Land <br />The City Council may by 4/5 vote of members of the Council <br />sell, convey and dispose of City Land or Buildings that the <br />City owns, but are no longer needed for municipal purposes. <br />Councilmember Kough proposed an annual auction of surplus <br />property as an option. <br /> <br />Discussion included statutory and delegatory authority of City <br />Manager; current policy; and taxpayer ownership of property and <br />equipment. <br /> <br />Councilmember Ihlan spoke in support of Councilmember <br />Kough's proposed resolution, suggesting that the City Council be <br />periodically notified of surplus property available for disposal to <br />determine if there is specific interest in disposal of particular <br />items. <br /> <br />Councilmember Schroeder questioned whether this was an <br />attempt by the City Council to micro-manage the entire system; <br />recognizing that the unfortunate disposal of the historic fire truck <br />was a process Issue. <br /> <br />Councilmember Maschka spoke against the proposed resolution; <br />recognizing that disposal of the fire truck was an unfortunate <br />circumstance. <br /> <br />Mayor Klausing expressed his confidence in the current policy <br />for Council review of the purchase or disposal of items in excess <br />of $5,000 as outlined by the City Attorney. <br /> <br />Councilmember Kough highlighted the second area of concern <br />related to acquisition and disposal of City land, requesting a 4/5 <br />vote of members, citing the golf course and potential future <br />development requests as a specific example. <br /> <br />City Attorney responded to Councilmember Kough's questions <br />related to super majority and simple majority voting and <br />statutory language. <br />
