<br />City Council Regular Meeting - 02/14/05 <br />Minutes - Page 9 <br /> <br />enforcement. <br /> <br />Councilmember Maschka suggested that language be amended to <br />address the potential law of unintended consequences. <br /> <br />Chief Sletner opined that officers would need to use their <br />discretion and consider each complaint on a case by case basis. <br /> <br />Further discussion ensued regarding clarification of driveways; <br />quality of life concerns; decibel meters; witness observations; <br />complaint-driven nature of the ordinance; hours of ordinance <br />enforcement; definition of residential and commercial property <br />and sound violation restrictions; and ways for implementation. <br /> <br />Klausing moved, Ihlan seconded, adoption of Ordinance No. <br />1315 entitled, "An Ordinance Amending Title Four, Section <br />405.02 Adding Section 405.02 H., Amplified Sound from <br />Automobiles." <br /> <br />Councilmember Schroeder, while expressing appreciation for the <br />apparent direction, spoke in opposition to the motion, pending <br />further clarification and definition of a residential parking <br />facility. <br /> <br />Councilmember Ihlan recommended tabling action on the <br />ordinance, pending clarification and refinement of several issues. <br /> <br />Mayor Klausing spoke in support of the motion; noting that the <br />ordinance could be modified as needed at a later date. <br /> <br />Ci ty Attorney Anderson suggested that the ordinance language <br />be amended to strike "... or in a commercial or residential <br />parking facility, which is audible..." in 405.02: Specific <br />Restrictions, Section H." <br /> <br />Klausing moved, Maschka seconded, to strike the clause, "... or <br />in a commercial or residential parking facility, which is <br />audible..." from 405.02: Specific Restrictions:, Section H. <br /> <br />Councilmember Maschka addressed the potential law of <br />unintended consequences and expressed his concerns; but noted <br />
