REVIEWED/RECOMMENDS: <br />C v� Adjacent to Hersche] Street, Project P-73-21 �Gt <br />As part of the improvements comp7eted in the summer of I974, the City <br />constructed Hersche7 Street from 7.H. 3b Service Road to County Road B. This <br />projec� carries the identification number af P-73-21 and involved canstruction <br />of a new roadway between parceis owned by the Farr Development Company and <br />Allied Stores. <br />Over a year and a ha]f ago, the Gity received authorization from Ailied Stares <br />to ent�r on-�o their property for the construction of the roadway while nega- <br />tiatiflns were taking place on the permanent easements involved. 7he attornies <br />have now concluded tha� it is not possible to negotiate a settlement on this <br />matter and have recorrmended tnat the counciY authorize eminent domain proceed� <br />ings ta acquire the necessary par�els. <br />Recommended Action: Authorize the City Atiorney to commence eminent <br />domain proceedings for permanent easements on <br />property awned by A71ied Stores pertaining to <br />Improvement P-73-21. <br />
