<br />City Council Study Session - 10/17/05 <br />Minutes - Page 7 <br /> <br />City Manager Beets noted that, once consideration was given to <br />the retainers and specific services, the firms were comparable. <br /> <br />City Manager Beets sought specific feedback from the City <br />Council related to the City Council's selection of a firm; and <br />direction to staff as to how to proceed. <br /> <br />Further discussion included negotiation ethics, business <br />attributes for the City's benefit; fiduciary duty to taxpayers; City <br />Manager Beets' review of a specific proposal and retainer <br />calculations; municipal experience of firms; and further <br />evaluation processes. <br /> <br />John Kysylyczyn, 3083 N. Victoria Street <br />Mr. Kysylyczyn referenced his previous bench handout dated <br />December 13, 1998 related to selection of firms to provide legal <br />services; and opined the need to find independent professional <br />outside source to evaluate potential service providers to ensure a <br />regular fiscal review for professional services. <br /> <br />City Attornev Proposals <br />City Attorney Beets reviewed the process, review committee, <br />and criteria for evaluating proposals based on price, law firm <br />experience, and individual attorney experience. City Manager <br />Beets advised that staff was recommending the firm identified as <br />"8," the current incumbent; and sought Council direction to <br />further negotiate contract terms. <br /> <br />Councilmember Maschka concurred completely with staff's <br />analysis and recommendation. <br /> <br />Councilmember Ihlan took issue with the retainer of firm "8;" <br />and questioned staff assumptions. <br /> <br />City Manager Beets reviewed the scope oflisted inclusions in the <br />various proposals and their retainers versus identification of <br />billable hours and overall costs to the City; as well as the <br />experience in municipal law of the firms considered. <br /> <br />Councilmember Ihlan opined that the process of seeking <br />proposals seemed lost when the incumbents were recommended <br />
