<br />City Council Regular Meeting -11/28/05 <br />Minutes - Page 31 <br /> <br />10. <br /> <br />Consider Terrance Fenne's Request for a Conditional Use <br />Permit (CUP) at 910 W Highway 36 (PF 3691) <br />Community Development Director Dennis Welsch presented a <br />summary of the request by Terrance Fenne to construct a 1,008 <br />square foot detached accessory structure (garage) in his rear yard <br />at 910 W Highway 36. <br /> <br />Mr. Welsch reviewed the proposed location of the structure, <br />placed north/south on the lot for maximum tree preservation on <br />either side of the lot; and noted that the structure was the <br />maximum size allowed under a CUP application. Mr. Welsch <br />noted that the property was zoned for single-family, residential <br />uses, and the reason for a CUP was due to only a 6 foot depth <br />overage for the structure. Mr. Welsch reviewed the installation <br />of a new driveway to be constructed on the north side of the <br />property; removal of an existing shed from the site; with the <br />existing attached garage to be remodeled into additional living <br />space. Mr. Welsch advised that neighborhood impacts had been <br />reviewed by staff; and the Planning Commission had <br />recommended approval conditionally as noted on the proposed <br />ordinance. <br /> <br />Mr. Welsch addressed comments heard at the Planning <br />Commission level from the adjoining property owner concerning <br />noise, screening, size, mix of materials; and specifically <br />reviewed the note of opposition received from the property <br />owners at 91 I W Sherren Street. <br /> <br />Councilmember Ihlan referenced the staff report, Section 6. I, <br />dated November 28, 2005, Section 1013.01 of City Code and <br />criteria used in review of a CUP; questioning whether the <br />Planning Commission had considered whether the size was <br />compatible with contiguous properties. <br /> <br />Mr. Welsch confirmed that the Planning Commissioner had <br />considered the size; the size of the overall structure; and the <br />actual 6 foot depth requiring a CUP. <br /> <br />Mayor Klausing duly noted that the CUP was for the 6 foot <br />depth; with Mr. Fenne not being required to make application for <br />a CUP without that additional 6 feet on the structure; and since <br /> <br />Resolution 10355 <br />Terrance Fenne <br />CUP <br />910 W Highway 36 <br />(PF 3691) <br />
