<br />03/09/04 <br /> <br />[REVISOR] XX/KJ <br /> <br />04-5779 <br /> <br />1 due to weather conditions, the pesticide application on the <br />proposed date is precluded; <br />3 (4) the product name and the United States Environmental <br />4 Protection Agency registration number of the pesticide to be <br />5 applied; and <br />6 (5) a prominent statement that reads: "This notice is to <br />7 inform you of a pending pesticide application to neighboring <br />8 property. You may wish to take precautions to minimize <br />9 pesticide exposure to yourself, family members, pets, or family <br />10 possessions. Further information about the product or products <br />11 being applied, including any warnings that appear on the labels <br />12 of the pesticide or pesticides that are pertinent to the <br />13 protection of humans, animals, or the environment, can be <br />14 obtained by calling the National Pesticides Telecommunications <br />15 Network at 1-800-858-7378 or the Minnesota Department of Health." <br />16 Sec. 3. [145.942] [DUTIES OF THE COMMISSIONER.] <br />17 In order to allow persons to avoid, to the maximum extent <br />18 possible, involuntary exposures to pesticides, the commissioner <br />shall: <br />20 (1) cooperate with other agencies and units of government <br />21 to minimize the risk to public health from pesticide exposure; <br />22 and <br />23 (2) adopt rules providing a uniform standard for <br />24 notification of persons exposed to pesticide applications. <br />25 Sec. 4. [145.943] [LOCAL ORDINANCE TO PROVIDE NEIGHBOR <br />26 NOTIFICATION.] <br />27 Subdivision 1. [LOCAL ORDINANCE.] (a) Notwithstanding any <br />28 other provision of law to the contrary, a city may adopt a local <br />29 ordinance comprising paragraphs (b) and (c') in their entirety <br />30 and without exception, including all applicable definitions as <br />31 provided in section 145.941. <br />32 (b) All retail establishments that sell pesticides must <br />33 display a consumer pesticide use information sign, consistent <br />34 with rules adopted under section 145.942~ in a conspicuous <br />S place. The sign must be placed as close as possible to the <br />36 place where the pesticides are displayed. <br /> <br />Section 4 <br /> <br />4 <br />
