<br />City Council Regular Meeting - 12/05/05 <br />Minutes - Page 32 <br /> <br />that property may be transferred or leased: (a) to private <br />entities that are public utilities or common carriers, or (b) <br />to private entities that occupy an incidental area within a <br />public project <br /> <br />Councilmember Ihlan reviewed the intent of the proposed <br />ordinance language intended to limit the use of Eminent Domain <br />for private developers; recent case law and pending legislation. <br /> <br />Mayor Klausing, and Councilmembers Maschka and Schroeder, <br />expressed no interest in pursuing the policy. <br /> <br />Mayor Klausing, while recognizing the valid concerns expressed <br />by Councilmember Ihlan, opined that the issues will come up in <br />the context of individual Eminent Domain use considerations. <br /> <br />Councilmember Kough sought individual Councilmember <br />feelings on the use of Eminent Domain. <br /> <br />Councilmember Ihlan sought to further engage 111 discussions <br />related to Eminent Domain. <br /> <br />Mayor Klausing opined his support of developing a policy on the <br />use of Eminent Domain, but objected to rehashing or arguing <br />over the Twin Lakes proposal in the guise of adopting a policy; <br />further opining that the real test would be when a particular <br />proposal was before the City Council for action. <br /> <br />Councilmember Ihlan reiterated her strong disappointment in the <br />majority Council's unwillingness to discuss the issue. <br /> <br />Roll Call <br /> <br />Ayes: Kough and Ihlan. <br />Nays: Maschka; Schroeder and Klausing. <br />Motion failed. <br /> <br />Councilmember Schroeder left the meeting at this time, <br />approximately 9:52 p.m. <br /> <br />12. <br /> <br />Consider 2006 City Council Meeting Calendar <br />City Manager Beets presented staff's recommended City Council <br /> <br />2006 City Council <br />Meeting Calendar <br />
