<br />City Council Regular Meeting - 12/19/05 <br />DRAFT Minutes - Page 7 <br /> <br />of 1 - 4 units). <br /> <br />Roll Call <br />Ayes: Kough; Maschka and Klausing. <br />Nays: Ihlan. <br /> <br />7. <br /> <br />Consider a Request by Kimco Realty to Rezone 1800 <br />Highway 36, former Frank's Nursery & Crafts (PF3680) <br />City Planner Thomas Paschke reviewed the request of Kimco <br />Realty Corporation for rezoning (from B-1, Limited Business <br />District to B-2, Retail Business District) to allow the <br />redevelopment of the former Frank's Nursery & Crafts property <br />into a retail and office development. <br /> <br />Mr. Paschke noted that, at this time, Kimco had been unable to <br />get adjoining property owners to agree to rezoning of their <br />parcels where non-conforming uses were evidenced (Sports <br />Authority parcel). <br /> <br />Discussion included the appropriate zoning for that parcel and <br />area related to parcels, not necessarily uses; lack of a site plan for <br />proposed property uses; differences in uses in B-2 and B-1 <br />zoning districts; existing holding pond and proposed asphalt <br />area; and the potential for underground piping to replace the <br />holding pond. <br /> <br />Mr. Paschke noted that the developer was unable to attend <br />tonight's meeting due to a scheduling conflict. <br /> <br />Councilmember Ihlan expressed concern regarding the proximity <br />to residential properties; opined that B-2 zoning seemed more <br />appropriate; the problematic intersection at B-2 and Fairview and <br />additional issues with a drive-thru for a proposed bank; and <br />inability for future City Council oversight of site development. <br />Councilmember Ihlan spoke in opposition to the proposed <br />rezonmg. <br /> <br />Councilmember Kough spoke in OppOSItIOn to the rezomng <br />request until a site plan was provided. <br /> <br />Additional discussion included public notification processes; and <br /> <br />Request by Kimco <br />Realty to Rezone <br />1800 Highway 36, <br />former Frank's <br />Nursery & Crafts <br />(PF3680) <br />
