<br />City Council Regular Meeting - 01/09/06 <br />Minutes - Page 13 <br /> <br />Mr. Paschke noted that staff recommended approval of the <br />rezoning request. <br /> <br />Councilmember Ihlan referenced the City's ordinance; opining <br />her opposition to the proposed rezoning and the adequacy of the <br />existing zoning; and expressing concerns that the rezoning would <br />eliminate any possible oversight by the Planning commission or <br />City Council for future input regarding redevelopment. <br /> <br />Mayor Klausing requested staff comment regarding the need for <br />rezonIng. <br /> <br />Mr. Paschke noted that the property had previously been "down <br />zoned" for the Frank's Nursery use; and staff opined it would be <br />appropriate to allow for greater uses on the site. <br /> <br />Councilmember Kough expressed concern that the Council was <br />approving zoning before uses were defined. <br /> <br />Mr. Paschke reviewed the role of the Planning Commission and <br />City Council in reviewing building permits and allowance for <br />permitted uses under various zoning districts; future uses <br />conforming to the site and required setback and parking <br />requirements; and opined that staff saw no detrimental impact to <br />F airview Avenue or the frontage road with the proposed B-2 <br />Zoning District. <br /> <br />Discussion included the future intent and purpose of the <br />applicant for the site; design standards versus a Planned Unit <br />Development (PUD) application; and no public involvement in a <br />future site plan. <br /> <br />Applicant representatives, Joseph Samuel, Project Manager and <br />Senior Professional Engineer with RLK Incorporated and Patrick <br />McCune of Kimco Realty were present. <br /> <br />Councilmember Ihlan sought comment from the applicant <br />regarding their motivation for requesting the rezoning from B-1 <br />to B-2, and why the current zoning of B-1 was not adequate for <br />future redevelopment, particularly when the development area <br />was adjacent to a school and residential area. <br />
