<br />City Council Regular Meeting - 01/09/06 <br />Minutes - Page 14 <br /> <br />Mr. Samuel noted that, while the bank would be permitted under <br />B-1 zoning; their proposed use for a sporting goods store and <br />additional retail was specifically not permitted under B-1 zoning. <br /> <br />Councilmember Ihlan reiterated her concerns regarding the <br />Council being asked to rezone a parcel when there was no clear <br />understanding of what the proposed use would be and potential <br />sale to someone other than the applicant. Councilmember Ihlan <br />opined that the current zoning was adequate; and opposed any <br />motion to rezone the parcel in order to maintain Council <br />oversight of future uses, concerns regarding traffic and turning <br />patterns and the proximity to residential zoned districts. <br /> <br />Councilmember Kough sought staff comment related to uses and <br />soil contamination issues; with staff responding that use impacts <br />would be less dramatic than the former greenhouse use and any <br />soil contamination would be the responsibility of the property <br />owner and developer. <br /> <br />Councilmember Pust sought, and staff provided, comment <br />related to the history of the site and the current non-permitted use <br />by The Sports Authority. <br /> <br />Councilmember Pust opined that this property had historically <br />borne traffic for a sports retailer and nursery; and given the <br />amount of public notice provided with no public comment to- <br />date at the Planning Commission or City Council level, it <br />appeared there was little public concern from adjacent residential <br />areas. <br /> <br />Further staff and Councilmember discussion included the <br />parcel's zoning history and designation as a Shopping Center <br />District; recent 2001 changes to the City's Shopping Center and <br />B-2 Zoning District definitions; and mixed use on individual <br />subdivided lots. <br /> <br />City Attorney Anderson addressed various examples for uses and <br />restrictions between a B-1 and B-2 Zoning District. <br /> <br />Councilmember Ihlan questioned staff s scope of notice for the <br />
