Mr. Anderson <br />concurred with Development Attorney Jim Casserly's <br />recommendation for the City to keep their options open with <br />possible inclusion of the property in a future TIF District within <br />a three year period. Mr. Anderson further responded to Council <br />concerns about their approval of Eminent Domain proceedings <br />by clarifying that the HRA can exercise their statutory authority <br />to act on Eminent Domain proceedings without the Council's <br />permission; and clarified that the HRA was simply asking the <br />Council to keep their options open by requesting action on <br />tonight's proposed resolution. <br /> <br />Mr. Welsch concurred; noting that in the past, the City has never <br />had the ability to correct these code enforcement issues that <br />create ripple affects in neighborhoods. <br /> <br />City Attorney Anderson referred to the opinion prepared March <br />2, 2004 by City Attorney Jay Squires in reviewing condemnation <br />statutes and HRA authority, and concurred with the opinion of <br />Mr. Squires, in the broader authority ofHRA's than cities related <br />to blighted properties, and was part of the purpose of creating <br />HRA's. <br /> <br />Mr. Welsch noted that Mr. Casserly was attempting to protect the <br />City of Roseville' s interests through tonight's requested action. <br /> <br />City Manager Beets noted that several years ago, the City <br />Council had authorized staff to present a fair market value for the <br />City's purchase of the property; but that the property owner had <br />counter-offered. <br /> <br />Ms. Bennett concurred with City Manager Beets' recollection, <br />and identified specific figures of that offer and counter-offer and <br />their correlation with fair market values. <br /> <br />Councilmember Ihlan expressed concern related to the authority <br />of the HRA as an unelected entity, and sought further <br />clarification by City Attorney Anderson. <br /> <br />City Attorney Anderson noted that this issue would go before a <br />
