<br />City Council Regular Meeting - 07/26/04 <br />Minutes - Page 27 <br /> <br />judge on August 16, 2004, and if someone contested the <br />authority of the HRA at that time, the judge would make a <br />determination. <br /> <br />Councilmember Ihlan reiterated her concern that the City <br />Council had not been consulted prior to the HRA's process; and <br />sought further explanation from staff as to the intent for the <br />property . <br /> <br />Ms. Bennett reviewed several alternatives under consideration by <br />the HRA, noting that the HRA would be very amenable to <br />consulting with the City Council on the future use of the <br />property; further noting that the Chair had been in recent contact <br />with the Mayor, and the HRA's minutes and agendas were <br />provided to the City Council for information purposes. <br /> <br />Mayor Klausing noted that this issue brought up an area for <br />further discussion on HRA authority without clear Council <br />direction, but was not part of tonight's requested action. <br /> <br />Councilmember Kough opined his disapproval of the use of <br />Eminent Domain, and recommended discussions with the <br />property owner. <br /> <br />Councilmember Maschka responded that the City had been in <br />consultation with the property owner for a number of years. <br /> <br />[2.1] Maschka moved, Schroeder seconded, adoption of <br />Resolution No. 10235 entitled, "A Resolution Determining that a <br />Certain Parcel if Occupied by a Structurally Substandard <br />Building and is to be Included in a Tax Increment Financing <br />District. " <br /> <br />City Attorney Anderson, in response to further quenes of <br />Councilmember Ihlan regarding TIF procedures, deferred to <br />Development Attorney Jim Casserly at a later date. <br /> <br />John Kysylyczyn, 3083 N Victoria Street <br />Mr. Kysylyczyn noted that the HRA authority was limited to <br />residential, not commercial properties.
