(Bonestroo Rosene <br />Anderlik Associates) for Variances and the Vacation of <br />Easements and PreliminarylFinal Plat at 2335 and 2361 W <br />Highway 36 (PF 3703) <br />City Planner Thomas Paschke reviewed the request by Bonten <br />Inc. (Bonestroo & Associates) for approval of variances, <br />vacation of certain public easements for storm water ponds, and <br />a Preliminary/Final Plat to combine eight existing parcels and/or <br />lots into three new lots for the property located at 2335 and 2361 <br />W Highway 36 for construction of a new and innovative 60,000 <br />square foot, four story office building. <br /> <br />City Engineer Debra Bloom reviewed the proposed actions <br />precipitated by the applicant's desire to redesign the existing <br />storm water pond that currently lies between the two existing <br />office buildings; fill the narrowest portion of the pond and install <br />two box culverts to connect the separated ponds and construct a <br />four story office building over the box culverts, with the new <br />office building connecting the existing structures and within the <br />public easement. <br /> <br />Ms. Bloom noted that the request was complicated and required <br />a specific sequence of events to occur. Ms. Bloom further noted <br />that the Public Works Department would not support the <br />Vacation of Easements unless it was confident that volume of the <br />pond would not change, as it was part of the City's <br />Comprehensive Storm Water Management Plan and was <br />imperative to the system that the pond's existing capacity not be <br />compromised. Ms. Bloom advised that the City hired S.E.H., <br />Inc. to complete a review of the pond modeling and redesign <br />provided by Bonten, Inc., and that the review concluded support <br />for the project; pending City Council approval of specific <br />agreements and/or contracts for improvements pertaining to the <br />pond redesign; indemnifying the City as a result of the <br />reconfigured pond, as well as cash surety in the infrastructure <br />agreement, and as part of the process. <br /> <br />Discussion included zoning of the area (Industrial and Business); <br />why the request was not being processed as a Planned Unit <br />Development (PUD); and the appropriateness of the land use <br />action as requested. <br /> <br />Resolution 10373 <br />Vacation of Certain <br />Public Easements <br />2361 and 2335 <br />Highway 36 (PF <br />3703) <br /> <br />Resolution 10374 <br />Bonten, Inc., 2361 <br />and 2335 Highway <br />36 and Owners of <br />Property <br />Addressed at 2357, <br />2363, and 2369 <br />Fulham Street, for <br />a Variance <br />
