<br />City Council Regular Meeting - 01/30/06 <br />Minutes - Page 20 <br /> <br />of the public, similar to the Uniform Building Code; City <br />Attorney Squire's legal opinion related to the insignificance <br />between the interpretation of strict liability misdemeanors versus <br />code violations as misdemeanors within the context of Minnesota <br />State Statute and City Code; and occupancy standards and <br />proposed enforcement. <br /> <br />Motion #1 <br />Ihlan moved to substitute the Shoreview Property Maintenance <br />Code for the International Property Maintenance Code. Mayor <br />Klausing declared the motion failed for lack of a second. <br /> <br />Further discussion included occupancy standards and if they <br />related to unrelated or related family members and staff s <br />interpretation of the number of occupants per room according to <br />square footage requirements; potential discrimination or human <br />rights issues with Section 404.05; and the ability for Council <br />review and amendment, even with the substantial vetting to-date, <br />that may be deemed advisable following actual use of the IPMC. <br /> <br />Mayor Klausing spoke in support of adopting the IPMC as <br />amended. <br /> <br />Ihlan moved to delete Section 404 from the Roseville' s adoption <br />of the IPMC. Mayor Klausing declared the motion failed for <br />lack of a second. <br /> <br />Councilmember Pust expressed continued discussion, opInIng <br />that there were a number of points in Section 404 that should not <br />be deleted; cautioning the square footage occupancy issues did <br />cause her some concern. <br /> <br />Given the short notice for the above-referenced amendment <br />regarding Section 404, Mayor Klausing suggested that the <br />Council consider the process by adopting the code, then <br />reviewing specific sections to allow additional staff input and <br />research as required. <br /> <br />Motion #2 <br />Ihlan moved, Klausing seconded, that all provisions of the IPMC <br />adopted as part of the Roseville City Code shall be fully stated as <br />
