<br />City Council Regular Meeting - 01/30/06 <br />Minutes - Page 22 <br /> <br />structures and that interior standards and inspections apply only <br />as to rental licensing requirements. <br /> <br />Discussion included previous staff examples for owner-occupied <br />or single-family homes identified as problem properties; interior <br />and exterior inspection stipulations and situations; public <br />confusion due to misinterpretation of past comments; and <br />clarification for property owners as to their responsibilities. <br /> <br />Motion # 4 <br />Ihlan moved to delete Section 101.2 (Scope) and amend it to <br />clarify that the code applies only to exterior maintenance or <br />owner occupied structures and that interior standards and <br />inspections apply only as to rental licensing requirements. <br />Mayor Klausing declared the motion failed for lack of a second. <br /> <br />Delete Section 104.4 (Right of Entry) <br />Minimal discussion was held regarding this proposed <br />amendment; with Council consensus not supporting this <br />amendment. <br /> <br />Motion #6 <br />Ihlan moved, Klausing seconded, deleting Section 106.3 <br />(prosecution of Violations). <br /> <br />Discussion included individual Councilmember rationale for this <br />amendment; previous discussion regarding elimination of the <br />strict liability language; provisions identified on Page 2, Line 24, <br />Section 106.4 of Attachment C-1 (draft ordinance) as the same <br />language as in current City Code. <br /> <br />Pust moved, Klausing seconded, a friendly amendment to <br />Section 1 06 (Violations), Section 106.3, Prosecution of <br />Violation, to amend to read as follows: <br />"Any person failing to comply with a notice of violation or order <br />served in accordance with Section 107 shall be deemed guilty of <br />a misdemeanor, and the "/ielathnl 8Rall ~e deemed a 8triet <br />liooility effcR8e. If the notice of violation is not complied with, <br />the code official shall institute the appropriate proceeding at law <br />or in equity to restrain, correct or abate such violation, or to <br />require the removal or termination of the unlawful occupancy of <br />
