Any action taken by <br />the authority having jurisdiction on such premises shaU [may] <br />be charged against the real estate upon which the structure is <br />located and shall be a lien upon such real estate." <br /> <br />Councilmember Pust suggested that this would allow staff <br />discretion, in consideration of City Attorney Squires' comments <br />regarding the authority already available under current City <br />Code. <br /> <br />Roll Call <br />Ayes: Pust; Maschka; Ihlan and Klausing. <br />Nays: None. <br /> <br />Delete Section 106.4 (Violation Penalties) and all of Section 107 <br /> <br />Motion #7 <br />Ihlan moved a variation of her proposed motion 7, to delete <br />Section 107.5 on transfer of ownership. Mayor Klausing <br />declared the motion failed for lack of a second. <br /> <br />Councilmember Ihlan expressed concern that this prOVISIon <br />would hamper owners or rentals or owner-occupied homes, <br />particularly if elderly and/or handicapped, from selling their <br />property unless properly maintained. <br /> <br />Mr. Welsch advised that this was misleading, as it was already <br />part of the seller's full disclosure to potential purchasers. <br /> <br />Councilmember Pust concurred with staff, citing the language of <br />Section 107.5 regarding owner furnishing disclosure or notice; <br />and opined it was advantageous for the City so Roseville <br />properties were left well-maintained and not "flipped" to a new <br />owner who would be responsible for overburdened maintenance. <br /> <br />Public Comment <br />John Kysylyczyn, 3083 N Victoria Street <br />Mr. Kysylyczyn opined that prospective adoption of the IPMC <br />had been considered by various City Councils since mid-1990, so <br />was not being "rushed for adoption." <br />
