<br />City Council Regular Meeting -12/06/04 <br />Minutes - Page 25 <br /> <br />roadway issues. <br /> <br />Councilmember Ihlan questioned that rationale for both drafts of <br />the resolution including a history of the development from 1988, <br />opining that this history was not relevant and should be deleted <br />up to the October 22, 2004 receipt of the petition. <br /> <br />Mayor Klausing requested a response from the City Attorneys. <br /> <br />City Attorney Scott Anderson noted that both drafts of the <br />proposed resolution (one to deny and one to grant the petition) <br />included a chronological history. Mr. Anderson noted their legal <br />opinion that it would be important for any potential future court <br />review of tonight's City Council action to be aware of how much <br />consideration had bone into their decision-making process, and <br />the amount of material that had been brought before the City <br />Council at various times. <br /> <br />Councilmember Ihlan spoke against the motion due to the <br />numerous issues raised during her previous discussion; and again <br />questioned the rationale and validity for including a history of <br />what she opined were irrelevant dates in the "whereas" clauses of <br />both drafted resolutions, rather than focusing on the petition <br />itself. <br /> <br />Mayor Klausing again thanked everyone for their comments; and <br />reminded the audience that everyone had been heard and all <br />points had been considered prior to the Council's determination. <br /> <br />City Manager Beets, at the request of the Chair, called the roll <br />for vote. <br /> <br />Roll Call <br />Ayes: Schroeder, Maschka and Klausing. <br />Nays: Ihlan, Kough. <br /> <br />Mayor Klausing, as Chair, declared the petItIon denied and <br />directed the City Attorney to notify all parties of the Responsible <br />Government Unit's (RGU) determination. <br /> <br />Recess Recess <br />Mayor Klausing recessed the meeting at approximately 9:03 p.m. <br />
