Regular City Council Minutes - 1/06/03
Page 3

Mayor Kysylyczyn asked that City Attorney Squires
review his comments on facility use, at which time both
topics could be discussed.

B.

Legal Aspects of Meeting Room Policy Regarding
Roseville Concerned Citizens for Fair and Open
Government (RCC)
City Attorney Squires reviewed his comments from the
bench handout regarding the current code Operating
Policy 10F regarding facilities available for public use;
and Park and Recreation Policies regarding no-cost users
not having purchased exclusive use.

Mr. Squires further addressed pertinent legal principles
related to and consistent with First Amendment rights
when consideration was given to public use of facilities.

Mayor Kysylyczyn opened the discussion for public
comment.

Diane Leifgren, 287 Roma Avenue
Ms. Leifgren stated she currently had a non-commercial
sign in her yard reading, "Peace, Not War," and doesn't
want to remove it.

Mayor Kysylyczyn asked for City Attorney Squires' legal
opinion on the sign's content. Mr. Squires stated that,
based on his review, the sign appears to present Ms.
Leifgren's personal opinion, and would be classified as a
non-commercial sign that would be allowed, provided it
met other City code requirements (i.e., dimensions and
location).

Carol Kough, 2931 Asbury
Ms. Kough referred to her previous appearance before the
Council expressing her concern regarding the "Save
Roseville" signs still being displayed over the holidays;
and the number of businesses and residents having
contacted her and Councilmember Kough requesting the
signs be removed; and questioning whether they were
legal.

Meeting Room
Policy
Roseville
Concerned
Citizens (RCC)
