Staff was directed to provide a firm cost to <br />Council. <br /> <br />Mayor Kysylyczyn sought a legal opInIon from City <br />Attorney Scott Anderson regarding placement of a policy <br />statement (i.e., whether to continue holding a municipal <br />Primary election) on the ballot, or if it was a Council <br />action. <br /> <br />City Attorney Anderson responded that there was no <br />provision within city code or state statute for calling for a <br />referendum to determine this issue. <br /> <br />Mayor Kysylyczyn asked City Attorney Anderson whether <br />the provision should be included in city code; with City <br />Attorney Anderson responding that he would want to <br />review the issue further prior to holding a referendum. <br /> <br />Mayor Kysylyczyn sought further opinion from City <br />Attorney Anderson regarding a potential conflict of <br />interest by sitting Councilmembers to vote on an issue that <br />would influence their re-election campaign. <br /> <br />City Attorney Anderson opined that he didn't believe there <br />was a potential conflict of issue regarding a vote on this <br />issue and pending Council re-election campaigns. <br /> <br />Mayor Kysylyczyn thanked Ms. Curti for her information <br />and the time and effort in her facilitation of the Task <br />Force, and then explained anticipated Public Hearing <br />process to be followed; with approximately Yi hour <br />allotted for the first portion of the Primary Election issue, <br />to be followed by the other Public Hearing regarding the <br />Presbyterian Homes Planned Unit Development (PUD <br />issue; with a return at the close of the Hearing to the <br />Primary Election issue to hear further public testimony. <br />
