<br />III. DEFINITIONS <br />The following tern1s, as used in this Agreement, shall have the meanings stated: <br /> <br />1. "Designated Reserves" n1eans a Retained Earnings account that holds that portion <br />of the Retained Earnings that Ramsey County has set aside for planned future <br />capital in1provement of the Range. <br /> <br />2. "East Metro Public Safety Training Facility" or "Facility" n1eans the building <br />structure, operating systems, fixtures, furnishings, and equipment for the East <br />Metro Public Safety Training Facility as described in this Agreement, including <br />the Public Safety Firearms Range, but does not include consumable training <br />supplies. <br /> <br />3. "First Priority Level" Ineans the right to use the Facility before any other users. <br /> <br />4. "Fourth Priority Level" n1eans the right to use the Facility after First, Second and <br />Third Priority Level users. <br /> <br />5. "Law Agencies" means law enforcement agencies outside of Ramsey County and <br />Washington County. <br /> <br />7. "Operating Costs" Ineans costs incurred to maintain and operate the Facility, <br />including building maintenance, staffing, and training equipment costs, but <br />excluding consun1able training supplies, cost of instructors, construction debt <br />service, and building replacen1ent costs. <br /> <br />8. "Other Agencies" means non-law enforcement agencies and private users. <br /> <br />9. "Parties" n1eans Ramsey County and Washington County. <br /> <br />10. "Public Safety Firearms Range" or "Range" means those components of the East <br />Metro Public Safety Training Facility that are used for firearms training <br />purposes, as specified in Section IV. B. of this Agreement. <br /> <br />11.
