<br />Regular City Council Minutes - 6/02/03 <br />Page 11 <br /> <br />Mr. Johannson advised that Roseville Properties would <br />not pay more than market value for the remaining <br />properties; thus creating the need to determine Council <br />willingness to use eminent domain proceedings if <br />required. Mr. Johannson advised that eminent domain did <br />provide for fair and equitable value for properties; but <br />they would continue to attempt to acquire the remaining <br />parcels. <br /> <br />Further discussion ensued regarding comparable <br />developments, with Mr. Johannson citing Maple Grove as <br />an example; the developer's preference for office <br />development if warranted by the market; types of housing <br />(i.e., life-cycle housing); developer studies completed to- <br />date and market preferences, with residential townhouse, <br />row house or condominium units anticipated in the price <br />range of $200 - 400,000, with affordability standards on <br />some units. <br /> <br />Councilmember Maschka asked the developer for a list of <br />similar projects in the metropolitan area for his personal <br />site assessment. Councilmember Maschka further <br />questioned City Attorney Squires and Mr. Casserly on <br />whether eminent domain involved the City in the chain of <br />title, particularly concerning contaminated parcels. <br /> <br />Discussion continued regarding language to <br />accommodate the chain of title in the Development <br />Agreement; adopted legislation to assist in determining <br />whether the City is a responsible party; developability of <br />property related to lenders and use of property. <br /> <br />Mr. Johannson advised that, on the portions acquired to- <br />date, Roseville Properties had volunteered to the <br />Minnesota Pollution Control Agency (MPCA) for several <br />programs, which would ultimately provide for a <br />certificate of completion and cover tenants, lenders, and <br />current and previous owners; and essentially provide an <br />indemnity warranty. <br /> <br />Concluding discussions related to comments on the <br />
