<br />City Council Regular Meeting - 03/13/06 <br />Minutes - Page 10 <br /> <br />New Locate Rules <br />Cities are now responsible for accurate records and locating <br />laterals in rights-of-way (ROW) constructed after January 1, <br />2006; cities must provide the best information available to <br />contractors for laterals constructed prior to December 31, 2005; <br />and cities will not be liable for hits to laterals constructed prior to <br />December 31,2005. <br /> <br />New Proposed Operating Practice <br />Permittees constructing new laterals will be required to provide <br />written and electronic mapping data; permittees replacing or <br />repairing existing laterals will provide written mapping data and <br />call the City to collect electronic mapping data. <br /> <br />Telecom ROW Users <br />Telecom ROW users, through the permitting process, agree not <br />to use its facilities in the ROW to deliver video programming <br />without first obtaining a cable or video franchise from the City. <br /> <br />Mr. Schwartz noted that the League of Minnesota Cities (LMC) <br />had recommended that cities update their right-of-way <br />ordinances to reflect the new requirements and to require certain <br />data be provided by the contractor when obtaining ROW permits. <br />Mr. Schwartz advised that staff had worked with the City <br />Attorney to draft an ordinance modifying the existing ROW <br />Ordinance; as well as previously-discussed language changes <br />related to pending regulatory changes for telecom facilities by <br />additional interim language. Mr. Schwartz further noted that the <br />Public Works, Environment, and Transportation Commission <br />had reviewed the proposed changes and recommended adoption. <br /> <br />City Attorney Squires noted a correction needed on the last page <br />of the proposed ordinance, Section 707.29, in the fourth line of <br />Subsection A, to show the actual Section referenced. <br /> <br />Maschka moved, Pust seconded, enactment of Ordinance No. <br />1333 entitled, "An Ordinance Amending Chapter Seven;" <br />Sections 707.02, 707.10, 707.15,707.1,719,707.22 and 707.29 <br />of the Roseville City Code, as corrected. <br /> <br />Roll Call <br />
