<br />City Council Regular Meeting - 03/13/06 <br />Minutes - Page 9 <br /> <br />Councilmember Pust thanked Mr. Forman for his patience and <br />willingness to work with neighbors and local government; <br />opining that he had shown exemplary conduct; and thanked Ms. <br />Kelly-Summers for her insightful comments and commended her <br />for bringing her family to allow children to learn their role in <br />democracy. <br /> <br />Mayor Klausing spoke in support of the motion; observing the <br />research provided by staff, the Planning Commission, and the <br />City Attorney regarding whether or not this particular proposal <br />met lot depth and length requirements; their interpretation of <br />current City Code and State Statute; and their expertise in <br />making these determinations. Mayor Klausing, in response to <br />Mr. LeTendre's comments, noted that the Council was <br />addressing the current request before it, not proposed scenarios. <br /> <br />Mr. Forman thanked the City Council for their openness and <br />support. <br /> <br />Roll Call <br />Ayes: Maschka; Pust and Klausing. <br />Nays: Ihlan. <br /> <br />7. <br /> <br />Proposed Amendments to the City's Right-of-Way <br />Ordinance relating to new Utility Locate Requirements, and <br />Adding Language relating to Right-of-Way Permit Video <br />Services <br />Public Works Director Duane Schwartz reviewed past practice <br />for all entities with underground utility infrastructure in the State <br />of Minnesota, and record keeping requirements, as dictated <br />through State Statute 216D, Minnesota Rules 7560, and the <br />Minnesota Office of Pipeline Safety, with locate requests <br />submitted through the Gopher State One Call system. <br /> <br />Previous Locate Rules <br />The City was required to locate utility infrastructure under city <br />ownership while the property owner was responsible for service <br />laterals; with the practice of marking the curb box for the <br />watermain and wye location for sanitary sewer, as well as the <br />main line; with utility contractors responsible for any hits to <br />laterals. <br /> <br />Ordinance 1333 <br />Amending <br />City's Right-of- <br />Way Ordinance <br />relating to new <br />Utility Locate <br />Requirements, and <br />Adding Language <br />relating to Right- <br />of-Way Permit <br />Video Services <br />
