Ms. Kelly-Summer opined that Mr. Forman was a man of integrity and had revised original plans to accommodate neighborhood concerns. Ms. Kelly-Summer asked that the City Council make a decision, one way or the other, noting that there were people involved, not just property and they needed to move on; that a civil solution was what the City of Roseville was all about. Ms. Kelly-Summer suggested that if there were ordinance amendments needed, this be considered as a separate item; but opined that there weren't many vacant lots in Roseville on which to build, and this offered a solution for those wishing to remain in the community. [7.1] Pust moved, Maschka seconded, approval of a minor subdivision for Jon Forman, Planning File 3699, (a three Parcel Minor Subdivision as per City Code, Section 1104.04E) creating three new parcels A, Band C (Parcel "B" to have the existing house) with a parcel size of at least 15,000 square feet, based on the findings in Section 5 and subject to the conditions of Section 6 of the project report dated March 13, 2006. Councilmember Ihlan spoke in opposition to the motion; citing her interpretation of City Code indicated that the comer lot didn't meet code; that an unreasonable interpretation was leading to an absurd solution; and the City couldn't grant a minor subdivision under City Code, Section 11 04.04E, without a variance; and that no hardship existed for granting a variance. Councilmember Ihlan opined that this request represented a serious policy issue for the City of Roseville regarding subdivision of large lots; and should be a concern of the entire community to preserve trees and open space before they are lost. Councilmember Pust spoke in support of the Inotion, opining that the request did in fact meet the current ordinance as it now stood on the books. Councilmelnber Pust concurred with Councilmember Ihlan that subdivision provisions should be discussed in the future.
